I've put my claim to MoneyClaim, just checked back and is giving me this option
Do you wish to enter Judgment by Default or by Admission? Please select one of the options below:

You will need to decide, how and when you want the defendant to pay. You can ask for the Judgment to be paid by instalment or in one payment.
The defendant admits that all the money is owed
(Judgment by Admission)
If the defendant has given a new address on the form of admission to which correspondence should be sent, update the defendant's details within the following Judgment request."

What option should i take, what difference does it make?
They are your two options for judgement and what response you have had from the bank will govern which one you take, they are essentially self explanatory. You do not need to decide between them as what happens with your claim will mean only one is appropriate.
Have the 14/28 days passed? If so and have had no response from the bank within your 14/28 days, then option 1 is what you need. Alternatively, has the bank admitted that they owe you all the money? If so option 2.Littlewoods catalogue - won back charges of £300 by default.

I am new to this site but thought I would write and say a big thank you to everyone who has put a posting on as it has really helped! I have now found the courage to fight my banks and get back my money - at first I was really wary of doing this as I have 2 accounts that are with collection agencies and thought that I wouldn't be able to claim my money back but after reading from page 1 to present (has took me about 3 days as I use internet at work!) I see that there are other people like me in the same boat so there is no need to feel afraid of the machine anymore!!!! have typed letters requesting for charges as per DPA but cant send them off til I have received cheque book from bank... will keep posting though and good luck to everyone in the further stages!0 -
Hi All
I am new to the forum but was inspired to make a claim to First Direct for charges on my current account amounting to £840. To my amazement they replied within 3 days of the first letter offering me £692. I realise I could go back for the full amount but in this case I am inclined to accept. My question is:
Does signing the very basic 'full and final settlement' letter have any other implications for future charges?......or if they do apply charges in the future do I have an argument straight away to have them refunded? Hopefully this would not happen but just in case........
Secondly, from others experience, are they likely to terminate my current overdraft facility and request full payment of my credit card which is with the same bank?
Very grateful for all the advice given here!

There are so many pages to this thread if i read them all it will takes days..:).
So i'll cut to the chase and ask if you can help.
I bank with Cahoot (a division of Abbey National) I gather we can claim back these charges from the past six years but their maybe a chance they could close the account. If they did this would they be able to close our loan account which we have have with them too..?.0 -

I'm new to this site, i decided a little while back to challenge my halifax for the charges that i've had over the last 15 months or so which are about £500. I went into the bank and eventually managed to speak to the manager (was about 2hrs!). They sent me a letter saying that they would not refund any of it (standard letter) and gave me 8 weks to reply. I've been busy at Uni and haven't had time to reply and now my eight weeks are up. Can i still try and claim it back?0 -
Of course you can - I had that with Barclays "8 weeks or we wil consider the matter closed". They can "consider" all they want, the money is stilll legally yours. I was offered a poor amount, so I deliberately let it expire to try to get another representative. Sent another letter, got a better offer from a new person, but still refused it, and put in a court claim for £450 on Saturday. Your move Barclays...0

Dear consumers
I have filed a moneyclaim against Egg for charges on my Credit card and Loan and have followed the standard procedure. They have come back with a defence saying that they intend to defend all charges brought against them (totalling somewhere in the region of 400 pounds).
The court has now sent me a questionairre in order to complete and to set a date for trial. This I am a bit worried now, since I though it would not rech up to this stage.
Egg also claims that they have had a previous victory over such claim and will be successful if I take them to Court. I need to return the questionairre by 12th November so any comments would be grately appreciated.

Egg are one of the more determined organisations out there, and will in all likelihood not only defend but may submit a counterclaim for the "actual cost" behind the penalty charges . This isn't a particular problem, just keep calm and read up at http://www.consumeractiongroup.co.uk/forum/egg/ - they won't want to disclose their true costs so you should be safe from the counterclaim.0
