Hello.. need some advice plz...
Received all my statements going back 6 years from First Direct..
Calculated that the charges came to £1783... sent a letter with a printout of the charges and asking for them to be paid back.....
Received a letter today offering me £1515...... should I accept or press on for the full amount.... part of me thinks I should accept and be happy with getting that much back.....
What do you reckon?

Yeh thats what I had to do... trawled through 6 years worth.. but received an offer just 14 days after asking for the amount to be repaid....0 -

This is my first time on this forum so apologies if I'm a bit amateurish!
Have realised over the last 18months I have been charged £835 in overdraft charges by HSBC, 99% of the time I was only overdrawn on my overdraft by one day due to mortgage going out before wages going in! Can I try and claim these back or is the bank in the right:

re Bank Charges - I was 'required' by Abbey Business Banking to open a new Account on my Business going 'limited' - they undertook to transfer all S/O's and D/D's to this new Account from the 'old' Account - they failed to do this correctly and also failed to respond to 33 letters and 17 phone calls pointing out their errors. They then made £590 'overdrawn' charges to my 'old' Account - I took the matter up with the Financial Ombudsman - very quick response - Abbey agreed to refund the £590 charges and make a payment of £200 in compensation - I objected to the amount of compensation and drew up a list of 'expense' incurred by me - some £1300 (including a claim for my two vans being of the road uninsured through the non payment of monthly insurance premiums - the Abbey rejected the Insurance Co's D/D application). The Financial Ombudsman stated that 'a complainant should deal with the 'Firm' in their own time and will not award loss of earnings or costs in relation to writing to the 'Firm'. He also stated that ' a customer of a Bank has to be reasonably robust in dealing with errors on their Account and will not compensate for each time an error may occur or each time they have to contact the Bank! All this despite damage to my reputation as a Trader through 'rejected' S/O's and D/D's - be aware that that a fair and equitable compensation cannot be got through the Financial Ombudsman (my opinion) - any comments or advice?0

Please Please HELP!
im in the process of claiming back unfair bank charges from lloyds tsb to the sum of about £4000 pounds plus costs. Im taking them to court due to fail attemps to resolve this matter peacefully with a letter requesting for the money.
Today i recieved a letter from the courts saying that the bank have entered a defence to my claim saying that the charges aren't a penalty so therefore are legally enforceable. They say that the charges were for extra services and that i knew about the charges before opening an account with them, therefore entering a contract with them.
Im now having dbouts on whether to go ahead with my claim as i have follow all the steps of this site but still the bank have not return my money to this day and it seems i've gone much futher than most...
Step 6 of this site tells me to come here for advice if the banks use this reason.
I don't really wish to go to court if it gets that far as i'll be a fish out of water considering their unlimited resources and funds!
Still wondering if to send back questionaire and another £100 for court allocation.
Can anybody help?

FWIW I am not aware of any of these cases actually getting to court, the bank settles before it has to explain itself before a judge. I'm currently taking on Barclays and am expecting an allocation questionaire any day now.
Barclays have a track record of dragging this process out, I don't know if Lloyds TSB do. Try checking the Lloyds TSB forums at http://www.consumeractiongroup.co.uk/ for more specific information and encouragement.

Hey all,
I've been following the bank charges saga and i felt brave enough to actually go thru the Dave Smith process. I sent a DPA letter to the Halifax (incidentally if u claim for 2 accounts, one being a joint is it still regarded as 2 separate claims? i got my joint a/c holder to put a claim on that account) and they sent me my statements for the past 6 years.
That was end of September, they responded yesterday, (well within their 14 days limit) and they tried to justify that their charges were legal blah, blah, blah and they also said that if i didn't conduct my account in the correct manner then they had the right to shut down my account...i don't care as long as they close it down and refund my cash then it shouldn't be a problem...
i have now sent them a 2nd letter for request of payment and given them a 2nd deadline... they know that i'm not playing now...
Incidentally, the wonderful Halifax offered me £254.00 worth of charges for 6 months...well, they know what they can do with that...
...So, I am waiting in anticipation...:rolleyes:

hi ive been reading this for while and there doesnt seem to be many people winning from lloyds bank, i am at the stage that i have issed a court claim and they have aknowledged it (giving them 28 days not 14 to respond) i am a bit worried that lloyds arnt paying out like hsbc or halifax who seem to pay out easy, should i be worried?0

I dont have any experience but I read on the CAG website that they hadnt heard of a case where Lloyds TSB hadnt paid out.“A budget is telling your money where to go instead of wondering where it went.” - Dave Ramsey0

Hi,
I've just been charged £30 by Nationwide for a direct debit that couldn't be processed because the money wasn't in the account (ironically a direct debit for a pension contribution WITH Nationwide) but the amount hasn't been charged yet, I've just had notification that it will be charged 28 days from the date of the statement.
Can I do anything about this now or do I have to wait for them to take the money before I can try and claim it back?
