  • Thank you to jonni2bad, have done as you suggest re paperwork. Have you got any idea on that thing about "services" I mentioned last. Apparently the bank might try and say the charges were for different services and that there is a way round it. They have sort of said this in their defence but I cant find the bit on this site about it. Can you help?

    I'm on this one and have had a reply from Halifax listing the charges and asking me to ring them if I intend to refer to Moneyclaim.
    Lloyds TSB have acknowledged my letter and are in the process of sending a list of the charges and Citibank are saying they will forward the charge information on receipt of a cheque for £10.
    How does this compare with others experiences, any tips?

    Hi, just a quick question. Am in the process of claiming against Halifax, have recieved a letter from court saying they are going to defend the claim. Has anyoneelse claimed from halifax? Does this mean I wait to get a date for going to court? Any idea how long it will be now before I get my refund? Also how do I now stop other charges that are now in process, just write them a letter or wait til I get my refund and then send a letter?

    also...(hours of diligence later)...i''ve prepared my initial letter to FD, together with the schedule of charges, all ready to go in the post tomorrow.

    meanwhile, i've done the same with Am Ex, but have yet another question. can i include the collection/referral fee levied when they pulled the plug & sold the debt to an agency? it was £200!!

  • I bank with NatWest and am looking at claiming back unlawful charges but I have my mortgage with them and a big loan. Can they ask me to pay back my loan and take my mortgage away?:confused:

    What are terms and conditions of the loan and mortgage. I'd say that they are entitled to act within those terms only.

    I think they are within their rights to ask for their money back if they give you so long in writing, though I'm unsure.

    I know my dad had to pay a loan off to LLoyds a few years back. He took his current account (which he paid a charge for) somewhere else. They asked about 6 months later to pay the loan off as they basically didnt want to do business with him anymore.

    He just got another loan to pay that one off.

    I'm not sure whether they can do that now though, but I certainly wouldnt rock the boat. They are closing peoples current accounts through this, so they are in their right to do so.

    One bank tried this over a year ago - if their actions are a service, then the costs for that service must be reasonable. Under the UTCCR Act, their charges would be deemed unfair (disproportionately high).

    If they want to face you in court and argue the case in front of a judge, let them try.....

    Try to avoid telephone calls unlss they can be recorded by you (you don't have to tell them you are doing this).

    Stick to letters and you'll have a record of everything that is 'said' in relation to your claim.

    They will pay up - in full..... £2835.92 in my case!
