    Hi Mel - Yes you can.

    If a credit card is with the bank that you have an current account with, then one Subject Access Request will cover all the information on both. Be sure to list each one on the request.

    In terms of claiming, you might be best to make separate claims, but you can certainly run them at the same time.

    Am' Ex' is just the same as any other card, so prepare yourself for another claim there too!

    Thanks Jonni2bad - i have the info - time to get writing! Almost I mean....

    I have another confusion. I know i don't add interest until i get to the point of filing a court claim, BUT that i assume refers to interest on the charges (ie my money that they have extorted from me). What about the interest charges themselves that they have levied each month (where i pay £40 & the interest takes up, say, £15 of that so my debt barely shrinks).

    Please help with this aspect & I'll get going.

    i understand that i could in fact only claim back interest that arises from the charges (obviously some of the interest arises from £s i actually spent). so the calculations would be very complicated. certainly beyond me!

    the letter of preliminary approach states : 'I calculate that you have taken £XXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXX'....could i put '£XXXX plus interest on the sum which you have taken', making it clear that i expect that repaid, yet not specifying the exact amount??

    any tips? what have others put?

    For my schedule of charges i have summarized from Bank Statements as follows : dates, amounts, what they said it was for. Is this adequate?

    This is my 1st post so sorry if I sound a bit thick.

    Do I have to state how much I am claiming in my preliminary letter or can I just ask for all charges to be refunded then if it goes to court have the amount worked out by then?

    In the process off filing my claim online against Alliance and Leicester.When completing the 'particulars of claim' section online, is this where i include a breakdown of charges, dates, and what they were for.
  • Hi, I have written to Barclays (twice) with the dates and times of the unfair charges. They had offered my half the amount but i declined and took them to Small cliams court. They have just posted a defence. Their first point was that i did not specify the dates and times of the alleged unfair charges!
    I was unsure what happens when i post the form back to court. Am i expected to be there. Will someone from Barcays need to be their. Will the judge automatically look at this and make a new ruling or by their absence does Barlcays lose? and i gain back my money
    Any advice/help appeciated
  • I followed the advice given by Dave Smith.
    Alliance and Leicester paid up after I issued the court proceedings.

    They say that they are going to contact me about my account as I am not happy with it's terms and conditions. Bring it on, it's the charfes I'm not happy with and they just don't stack up.
    If they make charges then I think they should be relative to the costs involved. Not the robbery taking place now.

    Has anyone else been successful and if so what did the bank come up with next.

    Nothing to stop you from trying, although since they are settling out of court, you would have to agree on an amount that you see fit directly with them. If you specify an amount, the best they can do is challenge it - so why not work out what you think is a fair share and if it is wrong, they should be able to tell you WHY it is wrong!!!
