Thanks for any advice on this one as if I can it will get the owned amounts down loads especailly when it was their charges that took me over the limits.

That's reassuring, I too am going through a debt management plan and currently my debt has INCREASED by £1200 in the last month due to a mirriad of charges. As I type i am going through all the companies and sending out the first 'Data Protection' letterDebt at highest ..............Debt (june 2006).......... Debt now (January 2010).......Debt free date (original) .......Debt free date (revised)

You need to go over to The Consumer Action Group and register with them. Within thier forums are all the template letters and all the guidance you'll need to follow this action through from begining to end.

I'm not familiar with Scottish law / terminology. Is the trust dead just a debt management plan, or similar to the English IVA, or bankruptcy?
If debt management, then you should certainly be able to get your plan for refund underway. If it is like the IVA or bankruptcy, then you would probably have to wait until it had been settled (not least because any refund would simply be split up between existing creditors under your agreement).0 -

I presume you have received the Allocation Questionnaire with this defence?
The form should have a number - either N149 or N150 - which one do you have?
These forms are actually quite straight forward, but you can use them to your advantage in asking the judge to order standard disclosure (not a guarantee by any means).
You should certainly include a schedule of charges, detailing the charges type, date incurred, amout, and the value of interest at 8%. Have you seen the spreadsheets for this on Consumer Action Group?0 -

Help Anyone, I am panicking!!! I have been with barclays for 5 years and have claimed back £900 in charges and interest from them. They have filed a defence and a court date in October 2006 has been set. What do I do, it says in the full article (The court will now set a date (if the bank hasn't already given your money back by this point - and most will have done). Some (actually only one has ever got this far) might actually attempt to win in court - they may claim that the charges are for an extra service and therefore not a penalty, and thus legally enforceable. If this happens, come to the forum - we have this angle covered, it's slightly more complicated but worth it in the long run.)
But I can't find it anywhere. Can somebody help?

I'm going to fill in the moneyclaim online form. I'm claiming for 2 accounts, both in the same name and with the same bank. Should I combine these into one claim, or make 2 separate claims?0
