Company refusing to honor warranty

I bought an electrical product from a store in July 2007 and on the box it says "2 Year Warranty".
Recently the item malfunctioned so I put my request in to return it assuming I am still covered on this warranty until July 2009.
July 2007 to July 2009 = 2 years.
The email they sent back said something along the lines of:
"Sorry, we cannot process this return because our goods only carry a 1 year return to base warranty and this item was out of warranty in July 2008"
I emailed them asking if the warranty is not with you then who is it with?
Them telling me they only have a 1 year warranty does not magically make that sticker on the box dissappear that says TWO years.
Already told them I am considering reporting it.
This is very serious to me because it is a major selling point of any product - the fact that it has X years warranty with it not only adds to the price more often than not but it also is sometimes the only reason you buy that product, because you know you can take it back if it goes wrong.
This store sells thousands of items and whilst they do have a good reputation, its only when you come to return an item you find they are suddenly not quite as forthcoming as you had thought.
Why won't they honor the warranty?

what is the product and who is the manufacturer...e.g. if its Morphy Richards (2 yr g'tee) you simply return it to them and they invariably replace FOC...so more info please and we can see what we can discoverI'm now a retired teacher... hooray ...:j
Those who can do, those who can't, come to me for lessons:cool:0 -
Hi :hello:
And welcome to MSE, sorry to hear about your problem.
Ok , as they are denying the warranty is too years it is now up to you to prove them wrong. The original packaging with the sticker and the recight is vital , I think its best if you take these down to the store and speak to them as normal and if you do not get a result go and speak to the manager.
If it still doesn't work then Tell them you are going to report them to trading standards. http://www.tradingstandards.gov.uk/ (Enter postcode in top left box to search for your local TS)
Obviously , when you purchased the object you beleived it had a two year warranty and that is exactly what you are ENTITLED too. Trading standards , i have been found useful especially as they know what there doing and can promote and exercise your rights as a consumer.
Stand your ground and don't let these companies get away with it
Good luck and keep us updated if you can

The warranty advertised on the box is supplied by the manufacturer, not the retailer.
Whilst the retailer may or may not have a liability under the SOGA, if you are claiming on the warranty as supplied by the manufacturer and advertised on the box you need to contact them about it.
If it is a 2 year warranty they will repair it no bother so no reason to waste time with the retailer.0 -
OK but they did not include any warranty card (guy in the shop said "that doesn't matter") and also I never registered with them, some manufacturers just say well you didn't register within 30 days of purchase, you have no warranty, although in the box there was NOTHING at all except the product! No warnings about anything like that, registering etc, but I know they will probably pull that one on me.
The manufacturer is "nVidia". Or is it "Inno3D" since many companies all put their names on nVidia cards like "MSI nVidia" or "XFX nVidia" so I am still a bit confused who to send it to, nVidia or Inno3D.
Its a graphics card.
Hmmm well if I have to send this hunk of junk half way around the world paying £30 postage to who knows where maybe its really not worth it but this card cost £180 thats the thing and theres not a chance I can replace it by buying another.
Worst of all I only have until 28th July 2009 to get it back to.... erm... someone.
Bloke at the shop did say I could do that and it would be quicker than the shop handling it, but I would have to pay postage, this was when the shop thought they were giving me a replacement.0 -
Could you get the shop to refund it,as it is "not as described" under the Sale Of Goods Act?0
-
The manufacturers warranty will be from the date of manufacture, not the date of purchase.
Have a look on the sticker on the card for this date or try the manufacturers website, on many you can tap in the S/N to check the warranty status.
The card may have been in the shop for a few months so you may be out of luck anyway (until all the "fit for purpose" Reasonable amount of time" brigade turn up)0 -

Yep,you need to get it repaired, then, not refunded, but they are disputing the length of time the warranty is valid, which seems a stumbling block don't ya think?0

It does have a 2 year warranty, the OP is just too thick to work out how to redeem on it.
The OP came on here for help not to be called thick! Have you never needed help before?:rolleyes:0 -

Work out?
So I am supposed to work out:
1 - This isn't 2 years from date of purchase its 2 years from date of manufacture. Thats not right because obviously the shop can deliberately not stock the product for 6 months, then sell the product claiming a 2 year warranty - whereas it is actually 18 months! Sounds illegal to me and should be the date I bought the card - I have a 2 year warranty - me. So then you mean to tell me all the months that card was sat there not being sold I still had a 2 year warranty on it even before I bought it? You'd have to be saying that.
2 - I have to pay god knows what in postage to send the item back to the manufacturer. If this were a cheap card it would easily cost more to post it to them than the item is worth. So then why would I think that?
Why would I be "clever" to think either of those things?
Maybe you're the thick one.
Yeah I will just go run out in front of a car, I love crapping on myself.
Remind me to never recommend this forum to anyone, you'll have to remind me with me being so thick and all.0
