Company refusing to honor warranty

    I said no such thing, if anything I said you had DOUBLE warranty as you can claim on the manufacturers warranty.

    I've claimed on IT warranties on quite a few occasions (with Ebuyer). Mostly Ebuyer have settled it with replacements but on two occasions (a Hard Drive and a Monitor) they have said no, but I have claimed from the manufacturer after filling in the online form (the Monitor was almost 3yrs old).

    But no matter what their website says, if you have a receipt saying you bought it on x/x/x then your warantee starts then and last for x years (in this case 2 years).

    nVidia design the cards, Inno3D etc actually make them using nVidia's designs. Contact Inno3D / MSI / XFX / BFG etc.

    The retailer has the extended warranty contract with the manufacturer and so it's for them to persue.

    On a personal note I would go down the route of least resistance as I did with my new shower. I could have gone back to shop but it was easier to get out the manu. engineer as I then got a free installation check.

    Thanks for all the replies.

    I have emailed the UK email address for Inno3D simply asking which address should I send back this card to along with a photocopy of the invoice, but they didn't answer, so 2 days later (yesterday) I sent the same email to the HQ office (Hong Kong) with a note at the top saying I tried the UK email and got no reply in 2 working days.

    Still waiting for a reply from Hong Kong.

    The longer they drag it out the less warranty I have left. :T

    Exactly 4 months tomorrow 28th July 2009. They gotta hurry up!

    I take it you don't envisage any problem with the overclocking (normally done at the users risk for obvious reasons) chances are if thats what caused the "burnout", your g'tee may be invalidated.

    and really if the card has been overclocked and burnt out as a result...do you really expect to get it replaced. A lot of manufacturers will only replace foc within the first 28 days, a lot will want to check/inspect the product first of all (you can still demand a refund or exchange)but they also have rights as well...

    e.g. after 18mths, you ask for a refund or exchange, they have a right to inspect/check the item before they refund/exchange or offer to repair in view of the time scale...you may be lucky...they may just refund/exchange...but don't be misled by anyone who says you have an automatic right under the SOGA to have a refund/exchange, especially after 18 mths....

    finally, if Ican prove the g'tee is 18/24/36 mths...I would go back to the retailer in the first instance, although as someone else has suggested, you often get better service going to the manufacturer.... but they may be able to identify abuse or abnormal wear and tear on the product...which weakens your claim

    No Torby I did not overclock the card myself, or ever touch it in that way, I never would - that would invalidate the warranty even in my eyes. :P

    No its called an "OC" but it is overclocked by the manufacturer, it was 500Mhz as the stock card, they themselves overclocked it and sold it as a 570Mhz card which is why I bought it, it was faster and pretty cheap (same price as the 500Mhz ones)

    So yes its almost certainly burned out because of overheating because of overclocking but I was not the one that did that, it came sold on the shelf that way.

    Well I have emailed 3 people now, Inno3D in the UK, Inno3D in Hong Kong and Micro Direct asking them the address for Inno3D and no one has replied.

    I noticed Micro Direct had absolutely no problem whatsoever adding me to their mailing list and sending me a ton of emails trying to get me to spend money on their products and yet they still arn't there to answer an email? Its funny how people pay attention sometimes and not others, selective attention, nice.

    Please take my email address off your mailing list.

    Please remove my foot from your greedy a$$, thank you.

    Now they are passing the blame to one another.

    Micro Direct tell me they only offer a 1 year return to base warranty and to take it up with Inno3D.

    Inno3D tell me (directly quoted from the email)

    "We offer our trade partners a 2 year warranty and they should honour this with their customers. As a Hong Kong based manufacturer we have no facility to accept cards returned from end users and trust our trade partners to use the channels we have in place. I would ask that you contact Micro Direct again and inform them that we have suggested this course of action"

    So, what should I do?

    Is it time to report this yet?

    I don't really want to report it because I think next time I email Micro Direct, telling them what Inno3D said, they might sort it out but !!!!!! come on I only have about 10 or 11 weeks left on the warranty.

    I know people here said don't worry its from the time you first wanted to send the card back and any disputes afterwards won't count towards time on the warranty, but these stupid dodging tactics BOTH companies are now using, passing the blame to each other... it will just drag out and they will end up not even replacing it!

    This is getting silly. I knew they would do this.

    Who is lying then? They can't both be right!

    Aside from the Mircro Direct "policy" and the Inno3D "policy" where do I stand legally? I mean, someone is lying, one company of these two MUST be covering me with a 2 year warranty because thats what it says on the box.
