yes i thought that also zaksmum with regards to nobody else having the manners to show up etc. you hit the nail on the head there with regards to "a reputable owner". i emailed the court today and pointed all this out to them, so hopefully they will realise that he is just trying to string this out for as long as possible. he obviously is not bothered or has more money than sense! I am taking your advice also regarding Holidays Uncovered. I have been in touch also with the Local tourist information in cornwall which deals with that part of the country. I will do my damndest to make sure that enough people get to hear about this guy.0

here is the next saga in my ongoing court battle with this idiot... he has asked the judge to set aside judgment as he was in hospital at the time of the court hearing as most of his brain cells had been damaged due to an inflammation of his brain and he had no recollection of the hearing date. wonder how he manages to keep 3 cottages going without any brain cells, obviously nobody else can manage to open his mail or take bookings for his holiday cottages .... hmmm ??!! the courts have given another date of may 6th back in taunton. i have asked them to move it up here nearer me in shropshire. i dont think its much to ask seeing as i made the journey all the way there last time, he should have some of the inconvenience of travelling up here, maybe i will make the same excuse as him and get the courts to set aside judgment again, and keep stringing him along the way he is doing with me ... see how he likes it.... it seems to me that he is just prolonging everything so that he doesnt have to pay any earlier than he needs to.
this guy obviously knows exactly how to play the system. looking forward to seeing him in court... there are a few things that i will be saying to him.
anyway guys, any help in how best to approach this court date in May? i have all the evidence and info etc, my only worry is that he will play on his brain illness and the courts will go all soft and let him off. if they do that then i dont think i will be responsible for my actions, especially if they reject my request for a court nearer home and i have to travel back down to taunton again.0 -
You could ring the courts and ask them,hopefuly they will need medical evidence to back up what he is saying.

Just to let you know whats happening. I am due to go back to Taunton Court on 6th May as they have decided that Mockridges medical condition does not warrant him coming all the way to Oswestry court near where I live. What about my medical conditions?? They really are taking the pi**.
So I have to go all the way down to Taunton again and hopefully this time the idiot will turn up. He really is stretching my patience. Its really not fair that this has taken up so much of my life, money, and blood pressure levels!! I requested that the court appearance be changed to nearer my home over 3 weeks ago, and they have only just today sent me a letter saying that it will still be in Taunton Court.
Can anyone let me know what happens with the £40 I sent to them requesting change of court as this was not sent back with the judgement.?

Again,interesting to know if they have asked for proof of his medical conditions,re the court ,or just taken his word.Have you found that out? If he's just messing you about,what if he deliberately doesn't turn up again?
If it turns out what he is saying was correct,how will that leave you financially?

I rang the courts and they advised that it was up to the judge to make the decision whether to keep it at Taunton Court or change to Oswestry, but the woman at the other end of the phone advised that they usually leave it in the defendants home town ie. Taunton, so I basically have paid £40 to the courts, but they had already decided to keep it in Taunton court! She advised that if I wanted I could send them another application form togehter with another £40 and they would consider it again! I asked whether it would be the same judge and she said that I could request another judge to have a look at it! But they couldnt guarantee that it would be changed to a court nearer me!
I am going to ring the courts again in the morning and ask them how the decision was made regarding keeping it in Taunton, if it was because of the medical condition of Mockridge I am going to ask them why my medical condition evidence was taken into consideration and why it wasnt even asked for!! I feel as though it was yet more money just thrown away.
Financially, should it go Mockridges way then I am obviously going to be out of pocket for the holiday but also for all the costs that I have incurred over the past few months.
I pointed this out to the clerk of the courts when i rang today, and told her that i had abided by the law and done everything above board, it had been myself that had done all the leg work and running around and paying out of money regarding the claim, and he had just sat back and done nothing! She did sympathise with me but as usual the normal comments of "i understand your frustrations etc!"
It seems to me that you get penalised in the courts for doing everything legally and above board. Whatever the outcome I will let you know, and everybody from his local paper and neighbours will be hearing from me - that is guaranteed ... so watch this space ... or watchdog on BBC1 ....

Yea, moneymaker, I claimed all that the first time round and it came to over £800 with the cost of the holiday. The judge awarded me all this, but Mockridge put in a claim to have the judgement set aside and we are now back to square one. But they way I feel at the moment, what if I dont win ... I am going to be out of pocket well over !£1000. I told the courts previously that it had cost me £62 to travel down last time together with 6 hours there and 6 hours back. It obviously didnt make any difference. Can I request that another judge sit in on the hearing on May 6th?0

If that's procedure,you won't change it. Sorry for your predicament though.
Some people "work the system",don't give up and hit him in his pocket,plus the stuff you put on the internet should be enough to curb him.
