    If you paid your money direct to Stilwells. It should be their responsibility to refund you. As they did not inspect the property and grade it. They sold you a mis-advertised holiday cottage. They are agents acting on behalf of the owner. So they are at fault. They should have refunded you then they demand money back from the owner. Seems like they fobbed you off and left you to deal with their problem. :(

    thank you so much for this. you know I never really thought about them being responsible. thinking about it they did take the deposit off me, so yes they should have taken more responsibility. thanks again for that. i have written to them and not heard anything yet, so i am now going to chase them up and request they reply to my earlier email

    Hi guys

    Just to update you on whats happened ....

    Had a reply back from the agents Stilwells who advise that according to Mockridge he was in hospital at the time of the court hearing !! yea right ...

    He is requesting the courts to set aside the court decision so that it can be heard in court again .....

    Now what do I do ?? He obviously is stringing this out for as long as he can. I cant believe that he has the balls .. if I got hold of him he wouldnt have any left !!

    I am absolutely furious that the agents Stilwells can obviously just take his word for it and basically wash their hands of everything.

    The agents have said, and I quote "
    Due to this we are unable to take any action with regards to suspending Mr Mockeridges advertisements and feel that we can not enter into any further discussion regarding Mr Mockeridges position with our company."

    They have just taken his word for it and basically "tough sh*t"

    Is there a regulatory body who I can contact with regards to Stilwells ...???? Help guys before I do something I may regret !!!!!!:mad: :mad: :mad: :mad: :mad: :mad: :mad: :mad: :mad:

    Hi just a thought if it doesnt compromise your court case could you not check when the cottage is booked and send a letter to the address for the holiday makers to send you their impressions of the cottage ie cleanliness etc not sure how you would stand legally perhaphs others could help here??? we pay a lot and trust others

    I really do think more people should speak out like this. You can look forward to a holiday all year and it can be a total letdown...why should we let it happen and do nothing? That just plays right into the hands of those who delight in ripping us off. If nothing else, at least the OP can make sure this owner's reputation and future profits are damaged.

    Have you spoken to anyone from Trading Standards, hendryclan? I'm sure advertisers can't make all kinds of totally untrue lavish claims about their properties. Is there anything in the small print of the brochure you booked from? Do they guarantee to have personally inspected their advertised properties, or that certain standards will be met as per each property's star rating?

    Or perhaps if you paid for the holiday with a credit card, would there be a possibility of claiming a refund through the credit card company? I know that if goods you pay for in this way are not as advertised, you can cancel the transaction. Not sure about holidays, but might be worth checking.

    Hi there,

    I have written to the courts today and asked them to let me know if he is submitting evidence that he was in hospital..... I wont hold my breath. This guy knows how to use the system for his benefit. I am hoping the court will see through this and not permit the judgment to go ahead.

    We will have to wait and see.... Have been in touch with ABTA who Stilwells are regulated by so wait and see what they have to say about this.

    sounds like you're doing all the right things there hendryclan.

    Even if the guy WAS in hospital, everything shouldn't grind to a halt if there are issues regarding his properties...doesn't he have someone to whom he can delegate? Anyway, that's not your problem. A reputable owner would be doing his utmost to resolve a complaint of this magnitude and it seems this man just couldn't be bothered.

    Why don't you also go onto Holidays Uncovered and leave a review of the property, naming all names etc., so that at least others won't be sucked in too. And what about contacting the Council in that area, and the local Tourist Information Office too?

    If the courts are agreeing with you by awarding your judgement, and you stick to the facts as you have done on here, there's nothing he can do about whoever you choose to blow him up to.
