    Hi all

Had a busy but good day here. Was woken by Miss A & W with my smoothie at 6am  but it was really yummy.

Seen my sis who has had a nice day (she did mother's day yesterday and b'day today!)

Also caught up with a friend and arranged a phone chat with another friend this evening!

    Hugs all round xx

    Hi everyone

seems quiet on here tonight. Had a pleasant day, sweet little home-made messages froms DSs this morning which was all I wanted. Mum popped round and loved her card and flowers this morning. A bit of quiet time when they went out and a lovely walk this afternoon with an old friend.

But I was torn between wanting to keep up to date so that I start the week feeling organised and not wanting to do anything because today is supposed to be special! We do make life complicated sometimes ...

Phil - I just wanted to echo whoever said that your school was lucky to have you, you sound like a warm caring person and there isn't enough of that these days.

Soappie - I add my pennorth of agreement - "grown up" children should stand on their own two feet! I think money and family rarely mix in any circumstances - best to give much more valuable currency of love and listening and being there.

((Hugs)) to everyone that found today hard, for whatever reason.

Just seen there's a new thread. See you over there!

I have posted this on another board but not had any replies and i was hoping one of you fantastic ladies or gents can shed me a little light.

As you all know I am in an affected pool of this round or redundancies and as i work part time i think it wil be me.
Our company don't do the finish friday get your redundancy money, they pay you this over three months on garden leave then give you whats left after the garden leave is up. You can be made to work the three months.
If i were to get another job in the mean time the payments would then stop.

Does anyone else's work do this?

Very confused due to lack of sleep worrying about job money bills etc.

But at least i have a nice clean house if i have to sell it

Your question rang a bell with me re a question asked on Moneybox live on wednesday last week re tax issues on this subject listen here

ZCC - just to clarifiy you are referring to is non contractual PILON (pay in lieu of notice) against a contractual gardening leave clause. Sorry to put my pedantic hat on but this is my bread and butter! Loosely speaking failure to provide work is breach of contract - hence pay in lieu of notice, so a lump sum of all notice due is paid, and tough on the employer if the employee finds another job in the meantime. The second option is contractual pay in lieu of notice - where employees automatically don't have to work their notice but are paid in one lump sum with employment ending immediately, the third option is gardening leave. This must be detailed somewhere in the terms and condition's (or agreed with the unions) 'an express provision authorising the employer to do so' to quote Yew on dimissals, that the company are not obliged to provide work but must contine to pay salary as normal to the end of gardening leave and that you must make yourself available for work if required. This can be paid normally rather than as a lump sum, can be terminated if you find another job. If it prohibits you from working for another company during gardening leave it must expressly say so. This is not provided for in statutory law, so it must be contract specific. Can be challenged if it is unecessarily restrictive, not commonly used for redundancy, more often to protect an employee when key people (eg senior sales people) leave. Sorry - off my hobby horse now :o . Not being critical of your advice in any way so please don't be offended but I can't just leave it. Can you see why I rarely stray into the employment boards? :o

Not offended at all!! I used to practice employment law, just wanted to provide a loose reply, as I haven't seen the contract!!

But, yes, you are correct.....there is a difference between PILON and Gardening Leave, and there may be a restriction clause (for example, my contract originally stated I was not permitted to work for another law firm within a 20 mile radius. This was too restrictive, as it would basicallyhave prohibited me from getting another job in my County, and I would have to move!! I had that removed pronto!!)
