i serioulsy would recommend getting some proper legal advice on this one, 4000 miles since its MOT?? I am The Seller, I Am Not A Dealer Or A Rally Driver! I Listed This On Ebay In Good Faith. The Buyer Chose To Come At 5.30 Although It Was Still Light,with Her Ex Husband Who Inspected The Car And Test Drove It. I Told Her About The Drive Shaft And Reduced The Price To £925. I Trusted Her And Did'nt Check The Money And She Shortchanged Me Of £10. I Was Not Aware Of Any Problem With The Steering But When She Informed Me I Offered Her A Refund Of £80 In Full And Final Settlement. She Said She Would Accept £80 As A Part Settlement Because That Would Get The Car Safely Back On The Road. The Following Day She Contradicted Herself By Saying It Would Cost £419 To Get It Back On The Road. But For The Bodywork The Car Would Be Worth More Than Double The £1000 I Was Asking. On The Ebay Listing I Stated The Bodywork Was Poor. Since Buying The Car She Has Carried Out Repairs In The Form Of Machine Polishing The Two Front Wings When She Says They Need Replacing. Why? I Do Not Think It's Reasonable To Expect A Seller To Take Back A Vehicle That Has Had work Carried Out To It.0

Well well, firstly can I say I will not get into a slanging match on here, it's not the place.
So just a couple of points:-
-Yes I did say I would accept the £80 in PART settlement
-Polishing a car is not a repair, it was that dirty naturally it is going to be washed and polished!
-Yes you are a rally driver, thats why you have been (and according to you still are) in Wales.
-Regardless of anything, the car is not fit for use, and not as described. This coupled with the terms of your auction offering full or part refunds if items are not as described, and that the morning following the purchase I contacted you and told you I wished to bring it back, should be sufficent for this to be resolved.
-The £412 I contacted you about is for the cost of replacing the windscree, the front lights, the steering column and steering rack, and the fitting. This is a very consevative estimate, but as you are aware I need to get a child to school so need a car on the road.
-If you need a more comprehensive report on the car, I will supply this as I will book the car in for another MOT in the morning.
Anything else you feel you need to say to me, may I suggest you contact me directly, this thread was started as I was seeking advice, nothing more.

Why on earth did you bother to polish this car if you realised it was in such a bad condition? Isn't that throwing good money after bad?0

Because polishing doesn't cost anything and was hoping it would make it at least look a bit better :-(

Sorry - when your seller said it had been machine polished I assumed that involved some sort of garage and therefore a cost. Hope you manage to sort this out soon.0

I merely wished to record the true facts for the benefit of other members. I have no intention of getting into a slanging match. I have made you an offer of a partial refund in accordance with the refund policy on the Ebay listing. The offer remains open until 17th March as previously advised.0

If you had read all the posts on the other thread you would see the errors were corrected and an apology made! There are always going to be two sides to this story and I think we will have to agree to disagree. If you decide to take the matter further legally a decision will be made for us and we will both have to abide by it.0
