Advice needed on problems after buying used car on Ebay.

    It's a private sale - the £80 offer is over and above what the seller has to do. The car is sold as seen.

    If I were the seller then I would let you waste your money on a court case, knowing that you wouldn't win UNLESS you specifically asked about an issue.

    Hi, I did specifically ask if the car was ok and safe to put a child in, and seller said it was, I did also specifically ask about the windscreen, and once again was assured it was ok, but no way of prooving this as it was verbal :-(

    Is this actually legal advice or a personal opinion? It's a private sale, however the seller did state....

    'that a full or partial refund will be given within 14 days if goods are not as decribed' according to the OP.

    So the buyer can dispute this amount. OP I would definitely not accept the £80 ask for a higher amount or a full refund. At a guest the faults it's got would probably cost you at least £500 to fix.

    Are there any advisory details on the checklist accompanying the MOT certificate? The poor body condition will not affect the roadworthiness (unless panels are literally hanging off or rusted through), but surely the steering faults and CV joints are MOT failure points? If it was only MOT'd around 8-10 weeks ago these parts must have been substantially knackered then. Compare the MOT mileage to the current mileage. Unless it's put on substantial mileage since I would be asking the garage that passed it for an explanation.
    In fact given the overall circumstances I would be wondering if the MOT cert is even genuine? If there is something dodgy about the MOT, that is your comeback, if it was sold with 10 months valid MOT.
    But I'm unclear how you know what the actual faults are, as you say you don't have the money to have it inspected?
    If you knew the car had been used for rallying, why did you even consider buying it for road use?
    No free lunch, and no free laptop ;)

    4000 miles since MOT, No advisories. I suspect it the way that it's been abused since the MOT which has caused the problems, didn't know until after buying that he was into rallying, if I had I wouldn't have touched it with a barge pole. I took the car to a local mechanic just for a quick look and thats what he came up with by getting underneath it, but by no means a comprehensive look, there could be other stuff that I'm not aware of.

    Just checked the auction details to answer my own question - he runs a non motor-related business that just happened to sell you a car.

    You could try to appeal to the seller's better nature :rolleyes: and put your concerns in emails to him but I wouldn't hold out much hope.

    Sorry I can't be more positive - just my penniesworth.
