i think if the op had got her own way then they would be on here telling us how we are all wrong, she has obviously gone to seek real legal advise and found out that she didnt have a leg to stand on, as was posted here quite a few times by various folk....work permit granted!0

Have been hoping to find out the outcome of this. Is this woman for real ? During the course of this thread she seems to be using double standards by complaining about having been sold an un-roadworthy car, whils't advertising an un-roadworthy Rover on E-Bay. A poster told her this and she changed it to say spares and repairs. Now she has listed a Mazda 323 saying it may need new brakes before an mot as they are a bit grindy. Does this not make this vehicle un-roadworthy too?0

Apparently it is, there are loads of consumer websites etc, and the one thing they all agree on is that the car MUST match the description, and MUST be roadworthy and should be expected to pass an MOT (unless sold as scrap), one site actually sugests that is is Ilegal to sell an unroadworthy car. I guess much of this is aimed at general classifieds where descriptions are very brief, so historically more difficult to use the "not as described" angle, whereas ebay allows the seller to give a more detailed description, and specify sale conditions etc. I did make a huge post earler in the thread about the diferent agenciesd and their opinions, but even the consumerdirect.gov.uk says even from a private seller it must be as describes, along with which, and

But I totally agree it is such a grey area, but as I am in a no win situation, hopefully if this goes all the way to trial then it'll help clarify it for lots of us. I have been advised that in theory I have a strong case, but who knows what happens should it get to court.
I dont suppose anyone knows of any similar cases that have presented to the courts, or indeed where I could find information on such?

Maybe you should READ te extract from the Road Traffic act, on what the issues they deem a car unroadworthy!! certainly not consumables like brakes!
So no ammending needed! There is no point in trying to read between the lines, and just picking on points to attack, if you dont understand the issues or te corresponding law, then what use is your post?
Especially as I have now twice mentioned the issue has been resolved.... so what use is your post other than to attack and recriminate??
Buy the car if you are so convinced and then take your chances! My description is HONEST!!!

ive read the whole thread and all ive seen is your double standards.
you complain about someone selling you a scrapper on ebay yet you do it twice in a week, pedalling death chariots to all and sundry. (meant in jest at the op's over reaction)

If the Road Traffic Act did not consider a car with brakes that were not working un roadworthy then the Police would not be able to give you a fixed penalty for having faulty brakes or faulty tyres as tyres are consumerables. The fact of the matter is faulty brakes does make a car unroadworthy and if you drove with faulty brakes the police could quite rightly give you a fixed penalty or prosecute you.
There is no arguable that the brakes are THE MOST important item on a vehicle.0
