    That is not necessarilly correct.

    My partner had his motorbike MOT'd afterbeing parked in his garage for the winter.

    Guess what. it passed. but while it had no mot did not make it roadworthy by any means.

    If I had of noticed there were issues with the car, under your definition then that would have been bad luck as I had entered a contract to buy??.

    In my understanding of ebay yes, if you don't like it there are loads of other places, or you could always go and look at the car first ;)...
