So sorry te hear what has happened. Please contact the Police immediately and advise them as to what has happened. With all due respect to them, the RSPCA are worse than useless when it comes to things like this and will take an age to investigate, if they ever do. ( I am speaking from dealing with the RSCPA on a number of occasions.)
The person concerned has committed an animal cruelty offence which falls well within the Police remit and if there's one thing any Police Officer can't stand, it's animal cruelty. Call them today and let them track down the witness for you and deal with it. He'll get dealt with more quickly and efficently.

Rather than phone the building company I'd put a very strongly worded complaint in writing AFTER informing the police and getting a crime number and then copy the letter to your local council and anyone else you may be relevant. If you can get a statement from the witness that at least ensures that action should be taken by the @rsewipes employer and with any luck by the police. Remember that while the RSPCA might be sympathetic they don't have the power to bring a criminal case so they have to work with the police and the CPS....so if you can get the police on side this guy is very likely to get a caution....sadly I can't see the authorities taking this to court, sorry.
I also wouldn't think twice about confronting the @rsewipe and verbally humilating him in front of his workmates if the authorities don't take action...but that's not for everyone to do, I know.
Maybe I'm just a very vindictive person but there is no way I'd let this man away lightly.0 -

I would def inform the police BUT I think a lot will depend on finding the witness otherwise there prob wont be a case.
I hope he gets whats coming to him though!0 -
