    I received the letter from Financial Ombudsman Service today, it reads as follows:-

    Your complaint about Lloyds TSB Bank Plc

    As you know, we wrote to the bank recently to pursue your complaint about its credit card account charges. We asked the bank to give us information that would be relevant to a formal investigation by the ombudsman into this complaint.

    We have now heard from the bank. It says it does not accept that its charges are unlawful or unfair. But following our intervention it has told us that it would prefer to settle the complaint as an alternative to our formal investigation. It accepts no liability, but nonetheless says it will pay £109.45 to settle the dispute. The bank has told us that this offer (in addition to £53.61 already refunded) represents a full refund of charges, together with a provision for interest.

    Acceptance of the settlement the bank has offered in respect of this complaint will not prevent you from bringing a new complaint in the future, should further disputed charges arise.

    If you would like to accept this offer of settlement, please sign and return the enclosed settlement form within the next 14 days. Please note that we would expect the bank to refund the amount of the offer into the account from which the charges were originally debited, or if the account is now closed (and no debt is outstanding), then a cheque may be issued instead. Alternatively, if the proposed settlement appears to fall short of your claim please let us have details of what remains outstanding and provide evidence to back up the claim.

    If we have not heard from you within the next 14 days we will assume that you have either settled the matter direct with the bank or do not wish to accept its offer or pursue the matter further with this service and will close our file."


    After receiving this letter I still have a couple of questions.

    I had previously thought the £53.61 (mentioned previously in this thread) was for something else, was a bit confusing, it got credited to my credit card account, then because the account was clear it was taken back again, it then got deposited into my current account though. I've checked back statements to make sure I got it, but I received no correspondence to explain what it was for, late charges or PPI???

    I've e-mailed the FOS this afternoon as follows:-

    I did receive £53.61 paid into my Lloyds TSB current account on 14th April 2009, but never received a letter or any notification as to what this amount being refunded actually referred to, it showed on my statement as follows:-


    14Apr09 DEP REF OF CHGS/INTERE 53.61


    Also, the £109.45 offer that has been referred to in the the letter plus the £53.61 mentioned about is being referred to as representing a full refund of charges, together with a provision for interest. Is this letter soley to do with late charges?

    I had also made a complaint regarding Payment Protection Insurance, is this still to be dealt with?

    I just need these questions answered before I think about accepting or not accepting the offer.



    So I will update you all when I get any more details, I'm not accepting anything at the moment though.

    My original claim was as follows:-

    Late Charges - "The charges total £100, plus as I believe I have been unlawfully deprived of the money I have calculated £33.53 interest at the statutory rate, the amount the court will award."
    PPI - I'd paid £350.47 and also mention 8% interest in my letter to Lloyds TSB

    Yes your doing the right thing here, hope they come back with some answers for you soon as well in regards of the PPI.

    Lloyds TSB rarely admit to anything, but keep at them.;)

    To make sure on this, I would ask the FOS, it can be confusing can it, the way this is calculated?

    I've got a reply from FOS as follows:
    I can confirm that the £53.61 paid to your account was indeed a partial refund of your charges and the offer on top of this is a full refund of charges with interest. This offer relates only to default charges on your credit card account.
    Your Payment Protection Insurance (PPI) complaint is being dealt with by another team.
    So looks like I should accept this offer for the late charges.

    Yes maybe that would be a good idea, with knowing that the PPI is being dealt with a separate team etc.

    Posted the acceptance form recorded delivery and checked online and it was delivered today.

    Regarding my PPI claim, I received a phone call from FOS about 10 minutes ago asking if I had a copy of the credit agreement, which I said I didnt - then asked how I signed up to the PPI, so I said it was over the phone and explained that I didn't think that I would have phoned specifically to sign up for PPI, that it was offered to me after my initial query.
