The seller has done nothing wrong from a business perspective.

The fact that he has broken ebay rules means that he'll get stiffed for that.

Put it another way - what happens if HMV no longer have stock? Everyone would then complain that the seller was selling things they didn't have.

I don't see the problem myself. If you don't shop around for the cheapest price then that's your problem?

I'd ask to return it for a full refund (less fee's), it isnt like he paid postage, or I would leave him negative feedback, I think you have every right to feel cheated whether he broke rules or not Ebay doe's require a certain amount of good nature from the people that use it, whats the sellers ebay name out of curiosity ??

No - it's drop shipping which is quite common on eBay.

You paid your money and got the item you wanted - it would of had to come from somewhere so whats wrong with this?

Soolin, I really couldnt agree with you less, I could think of much nicer ways of making 2 quid than to cheat somebody just because they are not an internet buff and if I came across that sort of feedback far from blocking them i'd be thanking them for the heads up.......credit crunch is obviously biting deeper than I thought, I hate that this sort of thing is even defended there is no place for it.....
"cheat"? It's called business. To Tesco's "cheat" their suppliers by buying theirs stuff and then selling it on in their stores?

If the seller didn't do this, then you would of ended up buying the item from a more expensive seller. But at least you'd be happy you wouldn't of been "cheated"

    Ex-dropshipper btw.

You're only allowed to drop ship if you say so upfront.

No - you just have to correctly put the Item Location in.

"Item Location - UK" would do fine.

    Pre-Sale listings

Pre-sale listings are those that describe items for sale that are not in the control or possession of the seller at the time of the listing. These listings generally consist of items that are sold in advance of a delivery date to the public.
eBay permits pre-sale listings only on a limited basis. The seller must guarantee that the item will be available for dispatch within 30 days from the date of purchase (i.e., the day the listing ends or the date the item is purchased from a shop front listing). The seller must also clearly indicate within the listing the fact that the item is a pre-sale item with a delivery date that indicates the item will be dispatched by the 30th day from the end date of the listing. Additionally, this text must be no less than the default font size of the eBay Sell-Your-Item form. Currently, the default font size is HTML font size 3.
