ebay buying query

I'd value any advice or comments.
I bought a DVD boxset from ebay at a 'buy it now' price. I recieved the item today and realised that once I'd paid, the seller bought the item from HMV's website for much less than he charged me. I know this because the seller even took advantage of the fact that HMV post for free and had them sent it directly to me! I know this because of the order details which were printed on a sticker attached to the DVD and obviously the outer packaging was from HMV too.
I've reported this to ebay but so far I've had no reply. Does anyone know if any ebay rules have been breached? Alternatively will I simply have to put this one down to experience and resolve to do better research the next time I buy (from my A level law days I'm kind of familiar with the concept that the law of contract doens't much care about 'bad bargains')?

Do better research.
No rules have been broken as far as I know, you purchased an item, they supplied it. The fact that you paid more for the item than it is worth is your fault. We have removed your signature - please contact the forum team if you are not sure why - Forum Team0 -
Sorry, but you saw an item at a price you were happy to pay and you've received it.
Why report the seller - they've done their bit, you have the item. I think thats a bit unfair.LBM : March 2008

I'd ask to return it for a full refund (less fee's), it isnt like he paid postage, or I would leave him negative feedback, I think you have every right to feel cheated whether he broke rules or not Ebay doe's require a certain amount of good nature from the people that use it, whats the sellers ebay name out of curiosity ??0

So you go to the shop and buy a loaf of bread, then report the shop because they bought it cheaper from the supplier.
It's the way business's work buy something - sell it for more. In this case I believe it's called dropshipping.
Seller has done nothing wrong apart from realising that some people are too stupid to bother researching themselves.
However as the seller is clearly doing this as a business, you are quite within your rights to return the item.
Negative feedback would be extremely unfair, buyer should try searching HMV next time instead of ebay.LBM : March 2008

Genius idea :T
Not one for the main account though
Only issue I'd have is the OOS thing- it's kind of taken out of your hands which isn't a good thing. This is my opinion. There are many others like it but this is mine:kisses2: Fiancee of the "lovely" DaveAshton :kisses2:I am a professional ebay seller. I work hard at my job, I love my job, if you think it's silly that's your problem not mine.

Okay so I guess the consensus is 'Buyer beware'! I supose the only other issue is from a Data Protection point of view - in that he supplied HMV with my details in order for them to send me the DVD without my being aware. With regard to the OOS issue - I suspect the seller would be able to rely on Partirdge v Crittenden (god it's 10 years since I did A Level Law and these little bits just keep coming back). I'd rather not revel the identy of the seller. I guess it just goes to show that it pays to shop around - a lesson well learned!0

Neutral or negative feedback is essential for keeping future ebayers informed, world is full of !!!!!!.....0

Informed of what? All it will show is that the buyer doesn't use the internet very often and on the odd occasions I have time and check the feedback left by buyers seeing a non positive left for this reason would get the bidder blocked from my auctions.
All the stuff I buy I sell on at a profit otherwise I wouldn't bother. OK I am maybe not blatant enough to have it drop shipped but I certainly have bought from major internet stores and then resold, I don't understand how else I can make money if I don't have a difference between my buying price and selling price.
About 3 years ago I made a very tidy sum buying a range of DVDs and books from Amazon, listing them on ebay at a 100% markup, they were the days!I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards.
