Just wondered if anyone had any advice for me on my previous post? I haven't started the ball rolling yet as I don't know if I have a claim?
ThanksAvon Rep

Hi Summer-Caitlin, the limitations would still apply to reclaiming PPI, but if it's less than 6 years since you signed your agreement, you can claim!0

Thanks, but it's not less than 6 years since I signed the agreement, I (we) took out the loan in 2001 but only paid it off in 2007, it was only when we paid it off did we realise just how bad the loan was!Avon Rep

You could always claim and see what happens.0

From what I understand and this may be wrong information, but does it have to be within 6 years of the end of the loan and not 6 years of actually taking the loan out? I have read on here and other forums that people have claimed successfully on loans and credit cards that were taken out over 6 years ago. We finished this loan in 2007 and as stated before, we were completely played. A £5000 loan and ending up paying back £21000, HUH!!!! As I said I was naive then, so didn't think too much about it, to be honest, didn't even calculate how much we would be paying back. We did pay it back 5 years earlier tan we were supposed to also, so I am still wondering why we paid so much.Avon Rep

Just started the ball rolling on ppi claim. Although I am not hopeful. As we have never received any letter from them except from the inital contract I don't think we will be getting any letter to say that there is no claim but that also probably means that we wont get a cheque either. We have never had any letters from them no statements nothing. We have gone along to voluntary termination process to get rid of the car which was got through them and the rubbish finance agreement but although they have car the account is not settled as they are saying we still owe payments for insurances but they are not able to send us the paperwork for us to see what it is. I think there may be a claim with the acceptance fee although I am not sure about this none of it makes much sense to us. We dont think there is anything left to pay. They say there is a charge we need to pay for a letter they sent on 16/3/09 although this letter was never received and the many letters we have sent them such as change of address and adding person to account that they will communicate with have not been acted upon. Any one that can provide any advice it would be greatly appreciated. Thanks
Vanderveckan I think we are probably in a similar situation so please keep me updated with how you get on with them and Di as you responded with some info would you be able to pass that on to me as well please.0 -
I'm not clued up enough on it, so I can only tell you how I would imagine Welcome would play.
You signed the agreement in 2001, but that wouldn't make it barred as you would have paid the PPI split over the monthly payments, so I would assume you could reclaim back at least the 6 years of your payments made to date.
The best way to find out is to get the ball rolling by putting your claim in, as Welcome are notorious for being slow at these claims. The information is on this site.0 -
Firstly sorry to you all for not being around recently. My pc died and work has been mad for the last couple of months. I finally have a working pc and im back with Vengance. Its good to see so many of us trying to reclaim our money. I have had two letters from the FOS and am still waiting for it to be put to an adjudicator. Looks quite likely that Welscum Finance will be history by the time I actually find out if I have won or not. Its also looking dodgy for Cattells. So if I win my claim the end will be different but Im informed that the Gouvernment Dept somewhere has to pay it instead. Probably at a lower rate than I would have received. How true this is I dont Know. Anyways fellow claiments keep going as Welcome are on their KNEES. And about time to for what they have done to us all. All thats left to say is OFF WITH THEIR HEADS.
Good Luck all.0 -
Hi Glenn,
It's looking less likely that they will go bust at this time due to the banks that they owe money to probably agreeing to roll it over. I can't think where but I read this a couple of weeks ago.
However, if they do go bust then yes, the financial services compensation scheme will pay out any money owed. It will take longer though and I'm not sure if you still get the full amount.
Yours is quite a recent case isnt it?
If you read the 'is welcome finance going bust' thread you'll see they are dealing with new cases a lot quicker.

Hi there
Sorry to have missed your post.
Have you tried by requesting a Subject Access request (SAR), here below is the link to the template for this, they have 40 days to comply and supply everything requested on the SAR.
However, there is a charge of £10 cheque payment or postal order for this request.
Post by recorded delivery:
http://forums.moneysavingexpert.com/showthread.html?t=1475553
If they don't comply contact the Information Commissioners Office (ICO), they should look into this matter for you.
They should be able to supply your info within 6 years if you live in England and Wales, Scotland 5 years, not too sure on anywhere else but any problems contact the ICO here:
https://www.ico.gov.uk/Global/contact_us.aspx
If you ever paid by direct debit for your finance, you may also track down the account numbers on them.
If you just require for a copy of the agreement, then just send them a £1 postal order or cheque payment, they should supply this by 12 days, and if you find the account numbers in your statements, add that on the letter when you request for the copy of your agreement.
Again any prbs, contact the ICO.
Good luck. The one and only "Dizzy Di"0
