  • This is outrageous, and you are not to blame. My friend was accused of stealing at work, on the basis of "you were the last person seen near the money before it went missing", and no other evidence, and it all worked out fine for her, because unless somebody has evidence of you taking the money you cannot be charged. You can't just accuse somebody on the basis of them standing near it. it sounds like a bit of a set up to me anyway. Why make a point of ringing up, and why then conclude that if the manager cant find it at home- you have stolen it. the fact that she said that money was at home originally is crucial. the money was either stolen or wasn't stolen. you cant say " oh two grand has just gone walkies, i'll have a hunt round for it, oh i lost it so it must be you.." Where i used to work, every huge amount of money was cashed up and accounted for by somebody and banked, not taken HOME! The fact that your boss doesn't know where the money is indicates their own guilt. You don't take 2k somewhere then just forget where it is!

Look at what everybody here is saying- it sounds totally dodgy and totally unreasonable, and any policeman or boss should be able to see this. At the end of the day you aren't responsible for this money, and i'd counter question whether its even company policy to have 2k lying around in the shop. this isn't your fault.

a manager saying you were "standing near the money" is not good enough. do what everybody here says and give acas a call- Monday - Friday 08:00 - 18:00 - 08457 47 47 47

They are an employment advice line, i've used them before and they are alright. if you can stand your ground and say you won't be attending the meeting, and rearrange, try and give them a call before you get into work on monday, they'll at least give you some pointers on how to act. Also if you work for a large company like subway, you should ring the HR/employment helpline and you can still ring it even if you've been accused. good luck- and remember you've done nothing wrong! and if it comes to it, don't be afraid to threaten legal advice, just to show them youre confident you've done nothing wrong.

  • also are you saturday staff only, or are you there all week? i ask because me and a friend used to work saturdays and sundays, and people would screw up money and petty cash all week long, then on saturday, we were the fall guys and when stuff got sorted out at the end of the week, it was always "anna and chloe who were the last people here" etc. etc.. and we had little implications made at us about the tills coming up short or petty cash missing £10 here and £5 there. Do you have any colleagues that are there in the week when you weren't that you could talk to, particularly friday night if you werent there? I'd ask first of all exactly when that money was placed there and if you were even present. and i'd say you certainly didn't witness it being put there, and cctv should attest to that.

My local burger kings manager had a shock when a new member of staff followed cash procedures exactly. It showed that the management team were stealing from the floats before they went out to the staff....
  • Report the theft now to the police:mad:.
Go in and make a statement, get a copy of it for your records
Ask the police to go and seize the tape so it cannot be tampered with

Send a copy of your statement to the franchise owner and demand an apology. I would even offer to have a lie detector test as long as anyone else with access to the money does the same (including the franchisee if he/she had access).

Do not take this lying down or you could end up with something dreadfully unfair on your record.

that was her opinion after seeing the cctv
  • Phone the police yourself, it should be your duty to report an incident where 2K was stolen! Sounds like your boss is trying to sack staff for "gross misconduct" to get out of paying notices etc.

Why would someone *not* phone the police when 2k was "stolen"? This just doesn't add up, just get the police involved yourself.
  • You definitely need legal advice.

Be very careful about saying anything in the meeting, particularly if they are taking notes. You have no control over how they record what you say in the notes of the meeting. If the police get involved they will take a copy of the notes.

My advice to you (as an employment solicitor, not a criminal solicitor) would be to attend the meeting. Tell that you are innocent and have nothing to hide. However, as the police may be involved in this incident, you want to take advice before discussing the matter. As kfor an adjournment to the meeting until you've taken advice.

If they refuse, you are in a difficult situation. People with less than a year's service can easily be dismiss. Therefore, if you chose not to say anything, they may presume you are guilty and dismiss. This may cause problems for you if you're applying for jobs and they want a reference from your last employer.

If you fight your corner they may record what you say in a way that does not reflect the truth. If the police get involved they may use the notes of the meeting against you.

How long have you worked there?
I am an employment solicitor. However, my views should not be taken to be legal advice. It's difficult to give correct opinion based on the information given by posters.

How can you report 2k as stolen, if you are not sure the 2k was there in the first place (or even existed)?
