After Msols have recieved judgement on my verdict of £325 to pay forthwith, they still have not decided to pay. Managed to finally get in contact with a manager/director- Sanjeev Singh who said that they cannot pay immediately and actually have 30 days to pay before the CCJ sticks to their records...So just a warning to those who do have CCJ's pending...they are aware of them and will take a long as necessary ie. until the 30th day after judgement to pay...If they do not pay me after those 30 days im going to be a bit stuck...I don't really want to enforce baliffs onto a virtual office in watford!!0

If you read the recent posts, you'll see they aren't concerened about the consequences of not paying CCJs (and don't pay within the 30 days to avoid getting them registered).
If they ignore an order to make immediate payment, and you decide to go down the bailiff route, there is no need to wait the 30 days before commencing enforcement proceedings.0 -

Not that it's much use, but interesting to know. I'm sure the Msols directors will be sitting pretty once they've wound up. Utterly appalling isn't it, that they can get away with it. They should be banned from being company directors for life.0 -
I think what seems to annoy a majority of people is the lackadaisical approach that is taken by Msols. One manager today had the cheek to suggest that I should find myself in a lucky position to be "recieving my money" considering many other mobile phone businesses-coolnewmobile/chatterbox etc... had gone bust. The point I re-itterated was that I had not taken a contract with them but Msols Ltd!0

mmm I need to read all this information and try to decide which method of enforcement may be successful. Are there any students who have been through this process? ... I ask because they would be exempt from fees, so what was the outcome? please share your information if there is anyone in the forum in this situation.

I'm a student that has successfully claimed twice on mobile rainbow...I must be 2 of the 3 'successful' claims! I claimed about £1100 from them for 2 separate contracts. (2x£550)
Details:
21/1/08 Filed Claim
14/3/08 Filed Judgement (I was a little slow as I had to send it in by post, online messed up) For payment by the 29/3/08
7/4/08 Filed for enforcement
15/4/08 Received payment! Along with a cheeky question of why I asked for enforcement as they were 'going to pay'!
10/5/08 Received cheque from court for Bailiff Charge
I'm not sure what you mean by 'exempt' for fees, I paid £60 for the claim, £55 for the bailiff, but received both back (eventually)! Ok we're 4 weeks on but hopefully a good reflection on their current status of paying (or not) cashbacks. Hope this helps.0 -

Msols have approached me with this deal:
Receive £325 Mcol Judgement (1st and 2nd installments +£25 court charge) by the 16th May
The £300 (3rd and 4th installments) left will be split into 6 monthly installments of £50 beginning on 3rd June.
What do ppl think? Should I carry out another Mcol Case for the 3rd and 4th installments rather than have this payment plan that they suggest?0 -
The court have ordered them to pay you £325.
They cannot now try and get you to waive your rights (as part of this ccj) to receive the future £300 as was originally agreed.
Should they not pay you your 3rd instalment as originally agreed, then you could sue them for the total outstanding on the contract due to the breach being relevant. (You could have issued your original MCOL for the full amount instead of the £300 you have been successful with).
But if you agree to this payment plan, you will have to hope they stick to it (or breach it before you can sue them again).
You don't say, but is the third instalment already late? If so, and following your success you may want to just refuse their "offer", insist the judgement is paid as ordered, and embark on your nect MCOL straightaway.0 -
Thanks Quentin for your advice. I didn't originally ask for the 3rd and 4th payment as legally it had not been 45days after I had submitted my cashback but now the time has elapsed for the 3rd and 4th installments, I would feel more comfortable taking the Mcol Route than Msols breaching the monthly £50 installment that they owe me.0

Out of interest to others in the same boat, if a party to a contract commits a fundamental breach of the contract, then the contract is broken, and the injured party is entitled to the full benefit of the original contract.
So if they don't pay one instalment as agreed despite you sticking to the contract terms and sending a proper claim then that breach means you can sue for the full amount, not just the late payment.0
