    yes, I think that's correct - if a companies gone bust and hasn't fulfilled it's contractual obligation to you I can't see how you can be charged !! but I would suggest you go to the Citizens Advice Bureau and just check with them - I think you can get an hour with a solicitor free of charge
  • Had a claim with the fos for nearly a year, still waiting for an adjudicator all i keep getting told is that they are in discussions with rbs and will be in contact soon this has been going on for months now.
    Does anyone know how and if the whole hardship thing works.

    Hi There it is very difficult to get put forward because of hardship. Saying that obviously you know your circumstances and could always give it a go. You will need to prove evidence e.g. bank statements etc. Give them a ring and ask or have a look on their web site.

    thats what i get told but the discussions dont seem to be coming to an end anytime soon:mad: what are they actually discussing ?
  • :mad:DON'T KNOW WHAT THEIR DISCUSSING BUT I WISH THEY'D HURRY UP, I WAS TOLD I WOULD BE ASSIGNED AN ADJUDICATOR BY 28 OCT, STILL WAITING WITH NO END IN SIGHT.

    Hi Hannah
    I understand how frustrating this is for you, one of mine had taken about 14/15 months, that was almost 2 years back and I know since then they have even higher volumes of these complaints.
    Some unfortunately have been waiting 2 years and still waiting.

    However, if in hardship, the best would be is to get some photocopies done of bank statements, this will help to prove towards any hardship in financial difficulties, also if your a client under a debt organisation, also enclose details of your client number and any copies of letters about your outgoings and so on, also if your in arrears with your mortgage and/or if there is a risk of losing your home.
    Also if any medical problems, things like that, if any of them apply to you do let them know and request for fast tracking.

    Hope this helps and that you hear of some good news very soon.;)

    No - embarrassingly the balance was never paid off at the end of the month :o
    Almost debt-free, but certainly even with the Banks!

    I think that's why your payment is sol low - they would only class you as having 'paid' for the PPI if you paid off the balance in any one particular month - I'll try and dig out what the FOS have said about repayment of ppi on credit cards

    I know it does not help but some are there for far longer and I think average time is 12/18 months now. I have had one there over a year now.
  • Anyone have any experience of having to write to their bank when they haven't heard back from them after the ombudsman has made their final decision and the alloted time period has passed? The letter from the ombudsman says I have to contact the bank directly, any advice would be most welcome.
