Thanks for swft reply - so the adjudicator decides whether he agrees with our complaint or not - I get it now. Any idea how long this more informal part takes - Lloyd seem to be digging their heels in on this:confused:

    Hi there

What normally happens is as soon as your case has been passed on to the first adjudicator, some are called caseworkers, they check through your complaint, and then request for information from the other party, in my experience I was told they give the other party approx 2 weeks to forward the information, sometimes they request for extra time, the FOS generally gives this with a deadline date.

As soon as they receive the info, they look at both sides, and if the fos agree this should be upheld they will write back to the other party and explain so.....
they give the other party a chance to look into this and if they agree the fos decision they will let the fos know, this again can be another 2 weeks or they may again request for a little more time like the last time.

The adjudicator will then let you know either by email and/or letter to let you know the outcome of this, it may be an offer from the other party, or they may move this on to another adjudicator who works closely with the ombudsman at this stage, they look again at both sides and if will let you know what they think and let you know if they have sent more details to the other side with their verdict of the case, the other party is then given a certain date to either agree or disagree, if this is disagreed by the other party, its then moved on to the Ombudsman himself for the final decision.

This can vary, from 6 weeks maybe to a few months while your case is actually being dealt with, hopefully yours will be sooner rather than later.

The longest part now I think is at the start while waiting for it to be allocated to an adjudicator, and as soon as they receive your complaint they are on that case.

They same adjudicator to what I know of deals with so many complaints at a time.....

Good luck and please let us know when you next hear something, there is no harm in sending them an email now and again just to see where they are with your case.....all the best.;)

    Hi,

We put in a claim not last december but the december before. It went to the adjudicator last january, and they have just sent a letter to say they decided in favour of us but hsbc have objected. It is now going to the Ombudsman to make a final decision, does anyone know how long that may take? This has been going on forever it seems.

    Thanks in advance

    Hi there
Its good news if the FOS have held this is your favour.

In regards of timing of these can vary, but now your in the final stages, it can take anything from a few weeks or longer, but keep in touch with them every other week or so, they will be able to confirm at what stage their at.

One of mine had taken 14 months from start to finish, yet it was rather a complexed case, hopefully yours will get sorted out soon, good luck.;)

You will need the evidence to prove the ppi was mis-sold. In what way do you feel it was mis-sold?

Have you ever made a claim within the 12mths on the ppi and been successfull

    hi there everyone.

I have been reading through some of the posts on here and I'm a little confused.

How is the refund worked out on a front loaded ppi.

Say the ppi is frontloaded at £2500 and its a ten year loan but you pay the loan up after 1 year. Do you get the £2500 plus 8% interest paid or only the 12 payments you made back.

I'm assuming that you paid the whole amount of the £2500 plus interest when you settled the loan. As its a loan within a loan?

Really sorry if I seem a bit stupid.

You can still claim or try to claim it but you will need to gather together your evidence to prove and show it was mis-sold, I think if you say to the company your complaining about you felt you could not say no, they may ask you why or they may dismiss it.

I was asking about claiming against the ppi its just if you claim on it for any medical reason etc you can't try and reclaim the ppi back, but you haven't so thats cool.
