They have said to "wait" again??? Its always the same story but I will not give up. Its gone on too long now and I can wait a little longer cause at least I know I tried. These rebate complaints are difficult to prove I think.

    The FOS asked me to resubmit my paperwork to them to again, so they can get someone to have a look to see who to write to, but it was after that I did not do this.

    I hope yours gets somewhere now on this Marshallka, its been a difficult one I know, but with a bit of luck they will get this sorted out for you, especially after a very very long wait.

    Hello Di, the FOS are currently asking Hamilton if they will take responsibility for my PPI mis sell with a loan I had with HFC,
    The problem is I didnt ask for PPI its just been added, we just dont know by whom!

    This is interesting.

    Ours was added as well without it being arranged as such or agreed to, the loan was with Endeavour, who are under the umbrella with HFC, where Hamilton was their insurers, at the time when the FOS wrote to them, they got back to the FOS and said HFC and gave their details.

    So are you saying the insurer actually added this then? Have HFC denied adding it then?

    But Click admitted selling it to you though didn't they?

    Click have only got back last year to say there is nothing they can do, and it was not their resonsibility because that actual company had dissolved.......:confused:have not actually heard from the Click who are responsible under that ref number.

    I read this ages ago about unregulated complaints

    If the seller was an insurance broker or some other seller, such as a car dealership selling PPI alongside finance agreements, then the sale of PPI would not have been regulated before January 2005. But you may still complain to the FOS about PPI sold before then if the complaint is about a claim - where the policy does not pay out when you think it should do.
    In this case it is the underwriters - the insurance company deciding your claim – that you are complaining about and these companies will have been regulated.

    You may even be able to claim that a policy sold before 31 January 2005 had been mis-sold if you can show that the terms of the policy contract were unfair – again it would be the underlying insurer that you would complain against..





    I have complained about the terms of my rebate in that i got an unfair rebate. I don't understand and after talking to the manager today he has told me to hang on BUT it will take a long time (months rather than weeks and I asked about years!!) and he then said he "really" did not know. All he could say was that there was lots of complaints like mine against insurers and that they really could not say whether they will get through the system or not as the Ombudsman is still in talks with the insurers. I asked if they had EVER got an insurer to take on a complaint and he said he had a couple although could not say who with or what about. He did say that Lloyds solicitors were not accepting any responsibility at the moment so they will just have to fight. i asked why they did not give a time scale and he said it was not a complaint yet that they had jurisdiction over. Its so confusing and we will just have to wait as at least they are trying. I made the complaint about the rebate first to FP and it got thrown back and then when I mentioned after it being thrown out about the terms in the policy being unfair they then listened to it. It was only then that they said who to complain to.

    But don't feel I'm going to get anywhere, and will try to find the old posts on here as well, I remember receiving emails from the manager from Click and posting them on here, don't think I've saved them......:confused:.

    Marshallka this one have been so difficult and you have done everything you possibly can, and due to this, you have missed out on lots of money, I just pray and hope to god that the FOS will get this done and out of the way for you, and make sure its all repaid back to you, its just not on, its been a total nightmare this one hasn't it?

    This would do my head in to be honest and you have gone this far, and now let's hope now "when they do eventually get round to dealing with this" it will be sooner rather than later.;)

    The only thing that will stop you getting this complaint in at FOS is timescales now as FOS advised who to write to etc and its well over 6 months since first complaining. As regards it being a complaint then yes, you can make a complaint against the insurer. Also Di, you could make your complaint against the insurer for misselling this to you according to what I was told yesterday. I would do that as you had no comeback with CLick or Endeavour. (it was endeavour that repossessed my house you know:rolleyes:) I think it would be a new complaint though. Not to sure but I am sure FOS could not throw it back then.

    We have missed out on money due to this and still are doing but have only ever wanted to get back what is rightfully ours. Nothing more and nothing less.

    Can i ask with most of the HFC/Beneficial Finance/Household banks closing (and indeed the one from which i bought my loan from also closed) are they still operating or have they become bankrupt?
