    So if he did not engage in any conversation with the sales advisor then this could be looked at as non advised.:confused:

    If it were non advised then really they say its up to the person who takes out the insurance to read and understand the policy etc. You just have to be careful what you put in your complaint I suppose.

    Sorry to but in here but I am sure Di will be along with more advice on this.

    I have received a refund from HBOS for mis-sold PPI. The cheque was for £650 - the original PPI was @ £1900. They have provided me with no breakdown of how they calculated this so I have no idea if they added interest.

    Probably a stupid question but should I bank the cheque, wait for it to clear and then write and ask for a breakdown? Just not sure it's enough.

    Were you told the original amount was to be £1900? Is the loan still active (assuming it was a loan) and the rest has been taken off the loan and the loan recalculated without it perhaps? If its not settled then you only get back what you have actually been out of pocket for since the beginning of the loan and the rest is used to reduce the balance. Also how was this redress sent to you? Did you have a letter with this amount in and also what about 8% statutory interest? Did you ask for that too? Sorry for the questions. Just trying to understand.

    I agree with Marshallka here, as it being non advised.

    And of course it does not cover you either, I would definately try to reclaim on this and also as Marshallks suggests, to be careful with the wording of your complaint.
    Annoying that you could not make a claim either as they said as you stated that there was no point in protecting you.

    Myself and hubby had joint loans with lloyds tsb and loan wise i was never protected, but they ticked ppi for hubby, although at one time due to his back problem he could not make a claim when he tried, yet again this was non advised as well, as these issues were not discussed on the purchase of the loans.

    Write to the bank (head office or if they have a separate complaints dept) and with the reasons you have, try to cover everything that possibly occurs to you and your hubby.
    You can use the templates on the link if you want to or otherwise as a guideline with your reasons you have, as you have to try to be careful with wording on this one.

    I'm sure you will get there though, if the bank does not resolve in your favour, then you do have the opportunity later on to take to the ombudsman.

    I'd thought I'd share my experience so far of my PPI claim, and see if anyone else had the same letter of reply.

    I sent a template PPI complaint letter to MBNA on the 23rd September, and got a letter back within a week, stating they are looking at my complaint and will reply within 28 days.

    So, do I wait for that time and for their response, or do I need to write back and demand they sort it out immediately?!

    For some background, my credit card is at £4800, and I've been paying PPI since 2003!

    I had no idea I was still paying it until recently. Stupid I know.

    Dread to think how much 'potentially' I could get back from them.

    Any thoughts/comments or experiences from MBNA's decision making would be greatly appreciated!

    Hi, you have to give the firm 8 weeks to resolve the complaint fully. If after 8 weeks they have not you then have the option of taking this further with the FOS or waiting (as the business may suggest) for another few weeks.

    Hello and welcome.;)

    They are entitled to 8 weeks, so if you hear absolutely nothing by the full 8 weeks, you are entitled to take your complaint to the Financial ombudsman.

    Did you see the article in the paper today.... I got the Sun and it says this....

Cleaner .......... became the first person to have her £8,000 credit card debt wiped because she was unfairly sold payment protection insurance. Newcastle County Court ruled credit firm MBNA wrongly took commission from Mrs ........ after she ticked "no" to PPI.


    I for one will be attempting to get something back as I have had an MBNA card since I was 21 ehh...... long time ago just thinking it is 18 yrs oh my god!:eek::eek:

    Hi, the loan is paid off. I paid it early. basically they said they would put me back to the position had I not taken out PPI. That was in the first letter. Then today I got the cheque with no explanation as to how they reached this decision.
