    I was under the impression that the cover was for the life of the policy, and only find out today that I have only got a months cover left.

    I think I will reply to the letter asking why it is not as I thought for the duration of the loan,. I do remember something from the sales man about the loan should only take about 5 years to pay off , which may be mis representation.

    I think you have a good case here, and if this were me I would be complaining on this and requesting they send you the full refund of all you have paid in PPI and the interest, so basically the whole 5 years of it, you do have great reasons for this and the FOS will surely see this in your favour.

    With you believing this was to protect the loan for the life it then you were not given any advice on this ppi.

    If you want to wait until next month, so that the 5 years are complete, so you can reclaim it all back, that is up to you, there is no harm in doing this now in your own time, but these policies are frowned upon.

    Go back to that link I posted and check it out, then when your ready try to reclaim on this for them mis selling this to you.;)

    Going back to Click again.....:o, still don't know where to start with this, knowing what to say to the FOS, as Endeavour were their lender, it could be the case again of going to the insurers??

    Do you think I should give it a go by emailing them first, just to see what they suggest, will have to tell them though that the Endeavour one have been resubmitted twice to them though but make them aware that the Click involved are dissolved, even though they still run many companies, and cannot go to FSCS on this one either.......

    Will FOS accept your complaint though Di? Its over 6 months since you had a final response isn't it? I thought that FOS wrote to the insurer on your behalf like with mine?
    If that is the case then FOS still has the complaint open unless you closed it when you were going to go elsewhere.

    Yes I heard but these insurer cases they told me today they as yet have no jursidiction over and although talks are going on nothing to date. I was also told it will not be in the near future either so don't know what to do or make of this one.

    Yes Marshallka your right, the FOS did write to the insurers Hamilton, then within a week or so afterwards, Hamilton got back to the FOS and gave the details of HFC.......:confused:, so the FOS did write to HFC for me, then they got back to say its nothing to do with them.

    They did say to send my details back, I didn't and wish I did now but since reading on here about many saying the FOS have recently suggested insurers its made me think about it all again.

    But don't hold much hope because yes, 6 months have passed.

    This was for the unfair rebate issue, but not for the mis selling of ppi, not unless I try on those grounds, don't know, its getting all confusing.

    Just wanted to make people aware that even though that lady has had her debt wiped off and the PPI wiped off, it was at the County Court. No other Courts *have* to follow the decision as its not high enough in the court system. But its still an excellent result for her and one that will help people with their own court cases in the future... but unfortunately it doesnt mean an instant win for anyone else in a similar position.

    (Hope this makes sense)

    In 2005 my husband and I took out a homeowner loan with the Halifax. My husband didn't accompany me, I dealt with the application. The loan salesperson did intimate to me that taking out a PPI with them would help the application and was very push regarding me seeing the person who dealt with PPI's and wasn't happy until I gave in and said I would see her.
    When I saw the PPI salesperson, she told me that there was no point in covering me due to illness, but she was very intimidating and pushy, regarding my husband getting a PPi with them, pointing out that he would especially need it due to my circumstances. At no point did she see my husband, so I wondered if you think that I stand a chance of claiming. Any thoughts would be appreciated. Thanks

    hi there i am with di on this one, you were mis sold and you need all the ppi payments back plus interest for that 5 years, they will then have to put the loan back in the position it would have been without ppi. if i were you phone fos and get their advice on making a claim for redundancy and the mis sell and they will put you on the right track, good luck with this and keep us posted

    Hi and welcome

    I think with your reasons you have a good case here, so go for reclaiming on this if you want to.

    I take it then a you have not made a successful claim on this then for EG: sickness/unemployment etc?

    You write to them with your reasons, do not worry about writing the amounts though.

    They have 8 weeks in full to respond, keep at them until they resolve in your favour, or until they issue you with the final decision, which should enclose details of the Financial ombudsman service (FOS), you can take your complaint to these if your not happy with the outcome.

    Best to post by recorded delivery as well, this is your proof of posting, and please keep us posted and ask for help when required.

    But it was FOS that told you to write to them. Its just like mine, FOS told me who was to blame and then FOS wrote on my behalf and I got a letter from LLoyds to ask for another 4 weeks but i declined and passed over to FOS. FOS then said it would be looked at quickly cause i complained they never told me this in APril when i first submitted for the rebate and misselling and the rebate one should have been against the insurer so FOS agreed that it would be looked at quick. Next thing I speak to someone that says I have to PROVE the rebate was unfair (they have to prove that the rebate was unfair as regards the FSA allowing rebates like that) and now my file is with a specialist team and they can not say anything other than it will be a LONG time again. I do not know if they can actually look into this even now..:confused:. I was told today there are issues with insurers etc. I told them that my rebate was definately unfair and I want a fair rebate which is my complaint and that rule of 78 being used in the rebate left me paying lots of interest for a policy no longer of any use. They have said to "wait" again??? Its always the same story but I will not give up. Its gone on too long now and I can wait a little longer cause at least I know I tried. These rebate complaints are difficult to prove I think.
