    With Capital one, I would send off the SAR and also a letter claiming a refund at the same time but two differerent letters and envelopes.

  • Good morning all,

    Has anyone had any dealings with the FLA? At the moment I've received all my data from one company and waiting on all the info from another (It has been over 40 days so I have made a formal complaint through the Data Access people - forgotten their names).

    I would like to know if anyone has had any success with the FLA and if so, can you provide me with any info. All that I read is how bad they are. Failing the FLA then the next step is the small claims court.

    What would be my chances of winning in the Small Claims Court? Basically the two companies in question who provided PPI on Store cards were exempt from the FOS rules at the time. However, I don't see why they should get away with it. If I was to lose in a Small Claims Court then what exactly would we be losing?

    Whats our chances in other words?

    Appreciate any info as always.

    Unfortunately the FLA can't make the companies pay out any compensation (unlike the FOS). So even if they agree that your PPI was incorrectly sold to you, the companies in question could easily ignore their verdict and refuse to pay out.

    I'd just fire off a letter to Capital One asking for a refund. If they refuse, write them another letter stating that you'll take the case to the FOS if they don't agree that the policy was wrongly sold to you.

    You can send a SAR, but if Capital One uphold the complaint they should calculate the refund correctly for you.

    How do you know for sure that only the first 250 were passed over for outsourcing? I hope this is true I am 195. Thanks

    the FSCS say they hope to make the first payments this month. This was in the link from pinknico.

    Hello sandzb, have to say not known for sure, just what another Picture claimant got told when speaking to the FSCS.
    The man from Deloittes said the claims were being done in date order ( though there are priority ones as well)
    The FSCS told me today mine went across on the 3rd July (the friday before they were declared in Default)

    Hi I would hope so - especially in the case of dialysis, she deserves priority. What happened there could easily have happened to my daughter and son in law. I am just thankful she let me know and we managed to sort it before things got any more desperate. Just hope they win this case and can get rid of their credit card and loan.;)

    Hundreds of former customers of Picture Financial Services Plc may be eligible to claim compensation from the FSCS now that the firm has been declared in default.

    The firm specialised in selling payment protection insurance (PPI) for mortgages and was declared in default in July. The FSCS is currently dealing with more than 600 claims connected to Picture Financial Services Plc. The Scheme is aiming to complete claims within six months now that the firm has been declared in default.

    The FSCS is gearing up to help customers of Picture Financial Services Plc who have a claim against the firm. The Scheme is already dealing with claims and we hope to make the first payments this month.

    Consumers who have lost money through their dealings with Picture Financial Services Plc may be able to claim compensation of 100% of the first £2,000 and 90% of the balance with no upper limit. Individuals who think they may have a claim against the firm should contact the FSCS on 0800 678 1100 or 020 7892 7300 or
