    Having used Martin's good advice with regards to PPI reclaiming I put in a claim with Auto Credit Finance on a loan I had on a car in 2006-2008, which I have now paid off in full. The didn't give clear information and I was self employed.

    I got the rejection letter from them and went through to the FOS, who last week, after a year, ruled in my favour. They have given them until 10th August to put forward any evidence. Having spoken to my adjudicator, they mentioned that Auto Credit Finance had ceased trading and that once they tell companies house I will be able to get 90% of the £496.41 they owe via FSA.

    how does this work? Is this true, can I get to them in any other way to get my money back?

    I noticed the b######s are still trading as Accept Car Credit as this is Auto Credit Finances trading name?? I had poor credit and got sucked, don't be foolish like I was and go with any of these.

    If the company you have reclaimed from have gone bump after or during your time at the FOS then it would now get passed to the FSCS I think and this is where you would get the payment redress from (or the people dealing with your company). It may take some time though for you to get this. Its horrible when this happens and I know of others that have it happen too and its a mess. I don't know about the 90% of the full amount due though and perhaps the FSCS or FOS can explain this to you.

    As regard the other trading name, this is also common. It needs to stop though and each should be responsible for each company in cases like this.

    Hi all - another 'nothing has happened' update! You'll recall that about 3 months ago the FOS said my case was outwith their timescales, despite their letter proving that I have complied with the timescales. They told Sainsburys that I was outwith the 6 years timescale as the missale deadline was on 22 Nov 2008 and I complained in January 2008 (I know, outwith the timescales?!). So, they said to Sainsburys that they were not upholding my complaint, yet I pointed out that no timescales were broken and that the case should be considered.

    I was told it was going back to the Ombudsman to 're-examine' the facts, yet despite that being the last week of April and first week of May, I've had nothing since. Am I suprised? Absolutely not.

    Hopefully the delay is because they are going back to Sainsburys to say, "Ooops, we made a mistake, give her the money!"

    I live in hope for a resolution to this before another year is through.
    Bathgatebuyer, is it now waiting for the Ombudsman to look into it when its already been before an adjudciator? If this is the case then this can take some time from what others have put on here. I would think it would sooner though than waiting from the start again.

    Is it worth writing back and saying this was pre-ticked. I was also going to mention that I was a student when I applied for this.

    Is this likely to work or should I just go to the FOS?

    It definately worth writing back andy as they always try the fob off at the first letter in the hope that you will go away. If this was not a final response then you have to write back anyway as FOS will not accept it until you have one. Good luck.

    marshallka, thanks for the advice, it seems to be a long up hill struggle to claim some of these ppi's, having read some of the entries..

    I thought about the court route, but that's costly, if I did take them to court I would be a creditor wouldn't I? I think it all depends on when they tell companies house, and they won't do that until they have scammed a few more unlucky people.

    I would think you could still get your 100% claim. Here are the compensation limits

    and it seems you still get paid 100% of the first £2,000 plus 90% of the remainder of the claim. Is your claim over £2K?

    Did post in your other thread, but not to worry, Marshallka have pointed you in the right direction here as well, good luck and it may be worth contacting the FSCS, they will let you know if they have this company listed as well.;)

    Bathgatebuyer, cant believe this is taking so long. My Ombudsman took two weeks to make a decision on mine once it was passed to him, please ring them and see where exactly your complaint is and who with, this is their mistake and you need to make a fuss.

    The FOS have lost a letter from Tesco offering me settlement of a credit card that they received on the 3rd July and now I am waiting for them to get Tesco to resend this. If I hadnt rung to see how my complaint was going I wouldnt have known they had made an offer and nothing was being done about it.

    I got told by stereo mike that ringing them gets you put to the bottom of the pile.

    I had this problem with my co-op one. The offer was made as soon as FOS requested the file from them and the original adjudicator went off sick. It was then sat on his desk and if I had not rang and got this actioned then no-one would have informed me. They also gave me 30 days to accept which ran over the time limit and it was then passed to another adjudicator to make the offer.

    Hi all, hope all is well and good. Miserable outside isnt it ? Will it ever stop raining ?

    Anyway, just want to throw this out there, and see what the general consensus is ?
    My girlfriend has had her Barclaycard since 2003 and whilst going through the statements recently we have discovered on each and every month a charge has been applied for something called Payment Protection Plan.

    The charge seems to fluctuate with whatever the o/s balance was. So if she believes she has been missold this policy can she reclaim it ?

    Does anybody know for sure if this Payment Protection Plan is a PPI type of insurance and secondly has anybody else been successful in reclaiming it.

    Presumably the monthly amount gets totted up plus 8% ?
    If you see a penny, pick it up, all day long you'll have good luck !!!!!! :D
