Not too bad here now thank you.:A

You will be fine now, I can't see FP being able to get out of this, and as they have such high volume of complaints, they WILL pay out :T:T:T, I'm sooooooooo happy for you.:j

Please keep me posted hun, this is so exciting.;)

You take care and speak soon. XXXX

I got a letter from MBNA saying they were dealing with my claim and would be in touch by end of April. Got another yesterday saying they are still looking into it and will be in touch end of May!

Bet they are trying to wriggle out of it. I am claiming as their boxes were pre ticked when I got the card in 2001

    Hi there

If you've no details, such as the loan agreement etc, you can write to them to request a copy of this by enclosing a £1 cheque or postal order payment, they should supply by 12 days, post by recorded delivery when requesting for this.

I would write back to them anyway and tell them what you have told us, if this did end up going to the FOS, they will sort this out for you.

    Good luck.;)

    Hi di3004,

I do have a copy of my agreement. but they are asking for a copy of the sicussion I had with the sales guy, which I don't have.

    Regards,

thanks only been about 1 month i am impatient lol hope they dont go under first i will never get my money:p

Hi, I've had a complaint about Welcome with the FOS since March 2008 so it does tend to take some time, called them this week and I still don't have an adjudicator and it will be 'a few more months', it can become dis-heartening but stick with it, you'll get there in the end.

I've heard somewhere that it's unlikely welcome will go bust at this time due to the banks rolling their debts over apparently so fingers crossed we'll be ok. I know some people want them to go bust but I think for us waiting for complaints to be seen to it will be quicker if they don't. And besides I'd much rather Welcome gave me back MY money than the compensation scheme!!!!

Good Luck and keep us posted...

I had two car agreements with Direct Auto Finance - Yes Car Credit who stated that i couldnt get the car agreement without the PPI and the Gap insurance. Should i be reclaiming this back?

I also have a loan with London Scottish who have gone into assessment can i still reclaim the ppi back from them?

In respect of the TWO car agreements. YES definatelty go for the reclaim. PPI is reclaimable.

The London Scottish however may be a little more complex. Yes you can certainly claim back the PPI still but you need to go the Financial Services Compensation Scheme. Have a look at their website which has actually got an article on London Scottish : -

    Good luck. :D
If you see a penny, pick it up, all day long you'll have good luck !!!!!! :D

    Hi there

If the 8 weeks have passed you are now entitled to move this on to the Financial ombudsman service (FOS).
I think they have that many complaints to deal with that do not help, but your rights are your rights, if you don't want to wait any longer if gone past the 8 weeks, if you feel you had enough, then move this on if you wanted to.

Meanwhile, with a bit of luck MBNA will resolve this in your favour for you, good luck.;)

    Hi there

They may be stalling this, its them that should be checking what they have on their database of any recordings/discussions etc, they should hold all these details, I would let them know that.

You could actually request a SAR (Subject Access Request), and they should supply you with everything requested within the SAR by 40 days, but there is a charge of £10 cheque or postal order payment for this request.
    SAR template here:
    http://forums.moneysavingexpert.com/showthread.html?t=1475553

How long have the given you to supply this info?

If not long then you can always try to FOS with any evidence from the SAR to support your case, keep on at them, keep us posted, good luck.;)
