    So, just to make sure, if I can't remember the loan account numbers I should use the Letter Template: Paperwork Request found in this section and state that I can't remember my account numbers but I need all paperwork associated with loans taken out under my name with all previous addresses. I think there were 4 loans in total, so I send a cheque of £4 and state they should supply by 12 days.

    Is this about right?

    Hi Guys, I've now received my SAR details form Cap One and wondered if anyone would be able to help me please?? :rolleyes:

    I originally had an offer of about £500, then they wrote to me last week offering a full refund of premiums plus interest totalling £1065.24. Their wording as follows:

    "Whilst we maintain that the PPI policy has not been mis-sold and I am confident it was added correctly, I have reviewed the amount of premiums that have debited your account. This comes to £1065.24 in total, which is inclusive of all applicable interest."

    Now my issue is, my account with them was opened in Aug 2002 and my SAR shows all statements from Sep 2002....fair enough! Now I've added all the premiums that have been added and my calculations show £1224.99.....This is without any interest?!! OK, so then I thought maybe they're only gonna give me the premiums for the last 6 years....so I then calculated from when I first complained (March 2009). So this was from March 2002 to this months statement....NOW this came to £1051.08.....without interest??!!!

    I really don't know where they're getting their figures from :o

    Not at any time does it state in their 'Final Response' letter anything about dates to & from, etc so I'm presuming they are willing to refund me the whole lot :rolleyes:

    I don't know what to write in my reply??? Please help!!!!!!

    Don't worry about the questions, this is all new to you and you learn here the same time......:D

    Right the SAR request if for everything requested on a SAR request, this one takes 40 days, the template for this added in my last post to you.
    And a charge for £10 postal order or cheque payment.

    The Credit Agreement request, they are £1 each again payable by postal order or cheque, this request takes 12 days.

    You could add your date of birth and any address if different to when you had the loans.
    This should help then track down your information on your accounts, good luck.;)

    Does anyone want a laugh?! I received a response from the FOS today about my complaint against Sainsburys - which was submitted in May last year - and apparently it's outwith the time limit for them to consider it!!! So, they are telling me that I have waited a year to be told I am outwith the time limit.

    Well, this isn't the end of it. If they'd actually bothered to read the information that was supplied to them, they would know that I was first made aware of my rights as far as PPI mis-selling in 2007. So, I contacted Sainsburys about this and the CCA issue in 2007. The FOS letter says I am within the time limits if I raise the issue within 3 years of me becoming aware that I had been mis-sold. Now, correct me if I'm wrong but it isn't 2010 is it? Have I slept so much I've missed a year of my life and noone has told me?

    I raised the issue with them of an invalid CCA being supplied by the Bank and asked them to consider that. It took them so long to consider that, that I then submitted my complaint about the PPI issue within the 6 years of the mis-selling to avoid missing the time limit. Yet, they still say 'you are too late'.

    To say I am angry right now is an understatement. I have put my finances - and life - on hold waiting for them to decide what is happening with this and they've taken a YEAR to tell me that as far as they are concerned it is outwith the timescale, while all along, I have tried to keep it within the time limits set by them. As far as I am concerned, I have missed no bloody time limits and they will be getting a rocket up the proverbial as soon as I've calmed down enough to type rationally.

    What a waste of a year. Idiots.
    Almost debt-free, but certainly even with the Banks!

    None of this is your fault.
    To what I remember there is someone else you can ask to look at your case for you, and for the life of me I cannot remember which section that is, or even who it is, I will try to find the info, but if not maybe Marshallka will remember.
    They should deal with your case in a fair manner and this is just not on.

    This is not down to you, so I would defo get more advice on this matter.

    So sorry to hear this bathgatebuyer, have they said what they are going to do with this case now?

    Looks like something is amiss doesn't it?

    Have they not sent you a full written breakdown on how they worked this out?
    I would request for this, they should post these to you on request.

    I would make sure on this first.
    Have they given you anything to sign on with a deadline date?

    Yeah, they've included an acceptance form for me to sign and return, but no deadline, just that if I don't agree to contact FOS.

    I think I may ring them and ask for a breakdown....it just seems as if they're stalling all the time :mad:

    I think there is a good chance that there has been a variable rate paid and as such the PPI + interest would not equate to the figure of the monthly PPI multiplied by the term of the loan.

    In addition your monthly PPI payment is inclusive of interest. The PPI Premium (cash price) on the loan does not include interest but the monthly amount is inclusive of interest.

    But not of course statutory interest which you can certainly claim you have an entitlement to.

    Hi and yes do request for this and then compare the figures to your own.
    Make sure they don't try to fob you off on the phone, tell them you want them posted.;) Good luck X
