    Di - they have said I must tell them if I disagree with their assessment of the case by 13th May 09. I think they'll be hearing from me a lot sooner than that! Ha ha!!!

    I will be digging out all my email to them over the past year because.......................sorry, just reached the bit in the file where I have an email that I sent to them telling them that de to the delay in considering my CCA claim with them, I was having to amend my original complaint to consider the PPI matter as well in order to MAKE THE 6 YEAR TIME LIMIT THEY HAVE!!!! Ding ding ding JACKPOT!

    And a letter I sent to them in Oct 08 telling them that I was having to amend the original CCA claim to include the PPI matter due to the length of time it had taken them to ail to reach a decision in respect of the CCA matter.

    That letter also clearly says to them that the "PPI terms and conditions were not supplied to me until 2nd August 2007! Clearly it's not 2nd August 2010 as yet is it? Or am I missing something?
    Almost debt-free, but certainly even with the Banks!

    Does anyone want a laugh?! I received a response from the FOS today about my complaint against Sainsburys - which was submitted in May last year - and apparently it's outwith the time limit for them to consider it!!! So, they are telling me that I have waited a year to be told I am outwith the time limit.

    Well, this isn't the end of it. If they'd actually bothered to read the information that was supplied to them, they would know that I was first made aware of my rights as far as PPI mis-selling in 2007. So, I contacted Sainsburys about this and the CCA issue in 2007. The FOS letter says I am within the time limits if I raise the issue within 3 years of me becoming aware that I had been mis-sold. Now, correct me if I'm wrong but it isn't 2010 is it? Have I slept so much I've missed a year of my life and noone has told me?

    I raised the issue with them of an invalid CCA being supplied by the Bank and asked them to consider that. It took them so long to consider that, that I then submitted my complaint about the PPI issue within the 6 years of the mis-selling to avoid missing the time limit. Yet, they still say 'you are too late'.

    To say I am angry right now is an understatement. I have put my finances - and life - on hold waiting for them to decide what is happening with this and they've taken a YEAR to tell me that as far as they are concerned it is outwith the timescale, while all along, I have tried to keep it within the time limits set by them. As far as I am concerned, I have missed no bloody time limits and they will be getting a rocket up the proverbial as soon as I've calmed down enough to type rationally.

    What a waste of a year. Idiots.

    In addition your monthly PPI payment is inclusive of interest. The PPI Premium (cash price) on the loan does not include interest but the monthly amount is inclusive of interest.

    But not of course statutory interest which you can certainly claim you have an entitlement to.

    I feel they will sort this out for you, but what on earth are they playing at?
    They need to sort this out and NOW !

    I've just rung them now, and they have said that I need to contact AXA for a breakdown???????? because they provide the insurance?? :rolleyes:

    The lender will know what proportion of your payments relate to PPI, they will also be aware how many payments you have made.

    They are definitely the correct people to contact for that information.

    The ironic thing is that they rebutted the CCA issue as being something they would deal with until I wrote to the OFT and they said, "Send it to the FOS as they deal with complaints over CCA compliance". The FOS then changed their mind and said, "You're right, we can deal with it" :rolleyes: And then rejected my complaint 8 months later! :rotfl:Surprise surprise.

    I'll give them a chance to reconsider this resending the info I have, but if they knock back my complaint again, I'll be complaining about the FOS themselves. They've handled this abysmally and will certainly take this to whomever possible to complain the dismal quality of service provided by them. Muppets.

    Thank you skv123....so I should carry on with Cap One then and not bother with AXA?!

    I've had my SAR through today but my calcs are different to theirs....

    Will write back to them and ask for a full breakdown :o
