I have 4 reclaims that have been sent to Black Horse for loans over the last 5 years all of which had PPI.
I have all the original documentation and so sent them the Claim letter, outlining my issues, which were for the first two claims:
your salesperson did not tell me that the policy was optional.
your salesperson implied that taking out the policy was essential for me to get the associated credit even though I informed them that I already had alternative insurance cover
your salesperson did not advise me that interest would be payable on the insurance amount.
They have unsurprisingly written back to me stating they are refusing the claim because I signed the Loan agreement including including the PPI, after having done a Demands and Needs questionnaire and that I signed the forms with the paragraph "By signing this agreement, I confirm that I have read, understood and accept the terms and conditions of our agreeement". But one of my reasons was that I believed I had to agree because I felt that I would not get hte loan with out agreement.
They also say that as I have no documentary proof in support of my claim they are unable to uphold it, butI thought they had to prove they sold it correctly to me, not the other way around.
I am now unsure of my next step.
Do I need to write back to them asking them for a breakdown of the exact amounts of PPI and associated interest I paid, and progress my claims directly with the Ombudsman?
I also wondered if anyone had been successful claiming PPI from them and can you also offer any assistance to me based on your experiences.

Hello! I'm helping my boyfriend claim his PPI. He has had almost an identical letter last week. I've just done a reply to them stating that it is basically not good enough (roughly based on the step 2 letter on this website) and saying that just because a questionnaire has been completed, does not mean that this expensive and complex product was adequately sold.

Capital One sent a pretty adamant no, to which i sent a pretty kick @ss letter back, and we've now had an offer of £290 - about 50% of his charges and interest on top. Was tempted to take it another step and see if we could get it all, however we have bigger challenges to face, namely with HSBC and thought the money would be more useful in nearly clearing his outstanding debt on his credit card.
So far we've had holding responses from Barclaycard and HSBC - should hopefully hear in the next week or two!!0 -

I will tell you anyway that they have 8 weeks to respond in full.
The template letters are useful on that link.
Write in your own reasons.
If they do not resolve this in the first response, they should give you the opportunity to write back again with further information.
In the final letter, they should give details of the financial ombudsman service if eligible.
Do you mind telling me how long ago this was taken out, what year?

I had a Barclaycard masterloan which i took out in june 2004 23.9% as thats all i can get... it has a single premium loan on it (PPI) does this mean i can claim this back??? I pay this back through a DMP will this change anything?
I only owe them £470 but they are claiming that i now owe them 2.8k!!!
£1230.00 if the amount of the premium loan part.Official DFW Nerd number 227

If you were mis sold PPI for any reason then yes go for it.
Not sure what happens when it comes to DMP though, there is a thread above Debt wanna be thread its called, you can always check on there.

Yeah I know what you mean.
But if you want to, you can always request a Subject access request (SAR), there is a letter template on the thread, this is below for you.
They should send you everything requested on a SAR by 40 days, it could be useful for your reclaiming case, but there is a charge of £10 postal order or cheque payment for this request, may be worth it though, good luck.;)
