    What year was this loan taken out?

    If within the last 6 years they should hold all the information they have on you going back that far, if in England and Wales anyway, Scotland though 5 years, not sure about anywhere else.

    It should be them providing you with info and not the other way round here, I think this is a stalling tactic myself.

    I would keep hold of it, or if you do get it copied and send them the photocopy, in case they mislay this.

    You could also request a Subject access Request (SAR), there is a letter template for this with details on site here:

    If and when they make you another offer and you feel happy with it then for instance, its always good to know how they worked out the calculations of this, in case anything is amiss, its worth requesting to send them a breakdown of how this was worked out.;)
    You could be missing out on a lot of money otherwise. X

    The loan was taken out in May 2002, so longer than 6 years, however i started the claim in December 2007.

    I may try the SAR route to see what information they hold on me, although i have kept originalks and copies of everything. As you say though it could be a stalling tatic.

    Yes a good idea to SAR them, even if they do only send the info as from 2003, there must be something in the SAR that should help your case, they have 40 days to comply, you will note the details of this on the thread I posted above.;)

  • I chased the FOS up again on 6th March. What i actually asked was, "has my case been passed to an Adjudicator yet because i have been waiting for 14 months". This was their e-mailed reply.
    I refer to your email.

    Your complaint is still waiting to be passed to one of our adjudicators
    who specialise in payment protection insurance-related complaints. Due
    to the nature of the complaints considered, most consumers are in a
    similar situation, in that they are suffering significant financial
    hardship due to the inability to pay loans/bills or termination of their
    claim. For this reason, and to be fair to all consumers, we try to
    allocate complaints to adjudicators on a date basis. It is very rare
    that we deem a consumer's circumstances to be such that they warrant the
    complaint being moved ahead of others with similar difficulties.

    I apologise for the delay in assessing your complaint; however, we will
    keep you informed of progress. Once your complaint is passed to an
    adjudicator, they will contact you directly.
    Now then, has anybody out there had a case with theFOS since 5th Jan.2008 when they first had mine, that has been dealt with. I wonder if the extra staff taken on by the FOS was to send out thousands of standard letters/e-mails of the type i have received.

    Yes i know they are busy at the FOS, but 478 days after they received it, the FOS have still not allocated to an Adjudicator. But you have to keep smiling don't you ?. Can anybody beat my waiting time or is this the record ?.

    Hi There I sent several in November 2007

    Barclaycard Loans x 3 was assigned to an adjudicator about April time settled in July (although still being queried by me)

    MBNA (A and L) One settled in about July

    other upheld and waiting to be settled now.

    Barclaycard PPI upheld and awaiting settlement

    Lloyds PPI on CC not even with an adjudicator.:confused:

    I went into a debt management plan last year with Invocas who are paying off my creditors with what I can afford.
    I know I had PPI on a loan from the RBS & also my Master card with RBS.
    Can I claim PPI back from them and get them to take it from the what I owe them?

    The adjudicator will go through your information, and contact the other party by requesting for them to send what they have, then the adjudicator will look through their information.
    Normally the adjudicator give them a timescale of 2 weeks to get back, but often its requested for more time, the adjudicator normally gives this but with a timescale of maybe another fortnight.

    After that the adjudicator looks through everything and makes their own findings and decision, if in your favour they write to the other party, in order for them to accept or reject the FOS views, with reasons if rejected.

    If the adudicator upholds your case and the other party do not agree, it then normally passed on to another adjudicator who works closely with the ombudsmanm their views may differ to the first adjudicator but its very rare.

    So it can be resolved in a matter of weeks, months or longer if the case becomes complexed.
    Hopefully yours will be resolved whilst still with the first adjudicator, good luck.;)

    I have 2 PPI claims all being dealt with by FOS could do with a win. I also have 1 PPI claim with FSCS because company gone bankrupt.
    I have claim for bank charges on-hold for 3year
