I'll let you know how i get on, thanks again I don't think I would be able to do this without this support and advice.

Your very welcome, we will do our best to help you through this, I know what its like when a company stop trading, you feel there is no other direction to go, but we can look into adminstrators, insolvency services and so on, and try to get a claim for you, if the FSCS are unable to help.;)

OK. A reply back from Captial One after asking them to up their offer to me of £1205.41. They said no more Mr G. :(

To re-Cap. Credit Card with them with £8,400 on it. PPI about £66 a month. Account open Jan 2004.

The Question? Do I try and get more by issuing a claim to the Financial Ombudsman?

    All help welcome guys.

    Hi Jules

Bet you feel relieved to finally know your case has been assigned with an adjudicator at last.....:T.

The adjudicator will go through your information, and contact the other party by requesting for them to send what they have, then the adjudicator will look through their information.
Normally the adjudicator give them a timescale of 2 weeks to get back, but often its requested for more time, the adjudicator normally gives this but with a timescale of maybe another fortnight.

After that the adjudicator looks through everything and makes their own findings and decision, if in your favour they write to the other party, in order for them to accept or reject the FOS views, with reasons if rejected.

If the adudicator upholds your case and the other party do not agree, it then normally passed on to another adjudicator who works closely with the ombudsmanm their views may differ to the first adjudicator but its very rare.

So it can be resolved in a matter of weeks, months or longer if the case becomes complexed.
Hopefully yours will be resolved whilst still with the first adjudicator, good luck.;)

    Hi there

If your not happy with the offer and its a big difference, you can ask if they are willing to higher this amount, if they don't do this or don't even consider giving an higher offer then yes move on to the FOS.
    Good luck.;)

Hi There, As indicated in my text, I have already done this with them and they have replied saying that they are not willing to increase the amount.

    Kind regards

    Hi John

I would say then go straight to the FOS, here:
    http://www.financial-ombudsman.org.uk/consumer/complaints.htm

You can ring the FOS or contact them by phone for them to arrange to send you the complaints form.

That is if you want to take this direction - if your not happy with the amount they offered, good luck.;)

    Hi
First time here,no sure if this is the correct place for advice.A relative split up with her partner 3 years ago,he had a secured loan on the house with PPI although the house is only in my relatives name NOT her ex partners.
She is a single parent and doesn't work, the ex partner has left her paying the loan, its been going through solicitors for 18 months and not getting very far.
Anyway, the problem is,she's tried cancelling the PPI numerous times and they say she can't.
Because its not actually in her name but she's still paying for it along with the loan.
Anyone know if this can even be cancelled or claimed back.
As she doesn't know what she's paying it for as she doesn't work so what is it even covering her for.
    Any advice,thank you?
P.S the ex is of no help on this matter,he doesn't want to know.

    Hi and welcome.

Sorry to hear of you relatives issues here.

I would check out the terms and conds of the policy, but despite that, your relative should be able to cancel whenever.

Make sure there is adequate cover in place though, just in case the unfortunate did happen - god forbid. The thing is being single and not working, yes its hard to get cover unless its life cover, so this ppi would possibly be worthless paying out for the whole lot of it for nothing. I would go for it here.

I would also check here for more info and letter templates on reclaiming:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

Every company work differently, it may be a case that if your relative did cancel, another loan would have to be taken out without the PPI.
Then your relative can still put in a reclaim to get the PPI back paid and interest etc.

For more help, please post up, but if there is a case, then go for it, good luck.;)
