    Ok, after months of headaches I have finally received a settlement figure from LLoyds. £2449.76 which I consider to be very low considering what I paid them.

    The breakdown of the refund is thus

    Loan recalculation after removal of PPI = £909.81
    23 monthly ppi payments (even though it was a single premium policy = £1000.73
    FOS compensation = £200.00
    Interest on premiums = £339.22

    Not being greedy but I paid them back a total of £12133.13 after 23 months on an £8000 loan including the rebate.

    am I being greedy or is this right.?

    Wow there is quite a difference there.......:eek:

    No your not being greedy, you go for the full whack hun, afterall its what you have already paid in - its your money, keep on at them, if they don't resolve this then take matters further, good luck.;)

  • I have 4 reclaims that have been sent to Black Horse for loans over the last 5 years all of which had PPI.

    I have all the original documentation and so sent them the Claim letter, outlining my issues, which were for the first two claims:

    your salesperson did not tell me that the policy was optional.
    your salesperson implied that taking out the policy was essential for me to get the associated credit even though I informed them that I already had alternative insurance cover
    your salesperson did not advise me that interest would be payable on the insurance amount.

    They have unsurprisingly written back to me stating they are refusing the claim because I signed the Loan agreement including including the PPI, after having done a Demands and Needs questionnaire and that I signed the forms with the paragraph "By signing this agreement, I confirm that I have read, understood and accept the terms and conditions of our agreeement". But one of my reasons was that I believed I had to agree because I felt that I would not get hte loan with out agreement.

    They also say that as I have no documentary proof in support of my claim they are unable to uphold it, butI thought they had to prove they sold it correctly to me, not the other way around.

    I am now unsure of my next step.

    Do I need to write back to them asking them for a breakdown of the exact amounts of PPI and associated interest I paid, and progress my claims directly with the Ombudsman?

    I also wondered if anyone had been successful claiming PPI from them and can you also offer any assistance to me based on your experiences.

    Hi there

    Did the letter state it was their "final response"?

    If not then write back, tell them you want this reconsidered, as your not satisfied with their response, and you have reasons as stated in your first letter on why you were mis sold the PPI.

    You need to exhaust their complaint procedures first until they state its the final response.

    If it was the final letter, then try with the FOS.

    You can download a form on their site above or ring them to send one through the post, then you enclose the final response letter (a copy) with the complaints form.

    I know there have been success with this company, but some still battling them as well, but keep at them, the best of luck.;)

    Got a phone call from my case worker today at work. Tesco have agreed to pay me back £2300. They have refused to pay it into my savings account and have sent me a cheque which my case worker should receive tomorrow and he is sending it out first class so hopefully I should receive it on Friday.

    I would like to thank everyone on here for their help and support. You guy's are great.

    Hi all,

    Had letter from FOS to say the Adjudicator had upheld my complaint and that Capital One have till the 14th May to respond. (this all sounds good to me).

    I just wondered if any-one had got this far and then the company still did not agree? If this has happened could you tell me how long it took for ombudsman to deal with complaint and has any there been any time that the ombudsman have not agreed with Adjudicator?

    Looking good then, that is great news.:T

    Sometimes at first stages the other party do not agree, if this is the case the adjudicator will generally move this on to the ombudsman or another adjudicator working closely to the ombudsman, for a final response, but sure all will be okay.:D
