    Trust me you do not need to take them to court, and if you know what charges they owe you you do not need to send for a SARS just send a copy of charges to the FOS with the complaint form. They will contact capital one and then Capital One will say ok we will pay it all.

  • Hi there just wondering if the letter im about to send to LLOYDS regarding PPI claim is all in order as im still quite abit unsure weather i can claim or not ?
    I have my Loan Protection Policy Documents here with me and have looked through them can't really make head nor tail of them to be honest!!:confused:
    Looks as if the loan protection was gievn to me as credit of 1,292.37 quid on top of the loan amount of 4,880.49 which gave me a total loan of 6,792.37 which was taken out in 2003.
    Here's what i've put on the template letter. is this correct way to claim? or should i be doing something else?

    I purchased the above policy from you in 10/10/03 but now believe that I was mis-sold this policy for the following reason.

    This is due to the fact that I was not given the correct information when the policy was sold to me, as your salesperson implied that taking out the policy would assist my credit application. Also as i was a serving member of the Royal Air Force when i took out the loan, which ment that i would be covered for sickness and redundencie so would not require PPI. the sales person was aware of this has they asked me about what benifts i recieved in the RAF, but still insisted that i take out PPI as would help with my loan application.

    Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

    I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

    If you read some of the posts from earlier the case worker trys to negotiate with Tesco for you. If Tesco don't make an offer then your case is passed to the adjudicator. Let's hope this is right and the fact that we have contacted the FOS is enough to give them the kick up the backside they need and hopefully we will win. Will keep you posted.

    If you did not need the PPI and were told you should take it out then you were mis sold. Send the letter and get back to us when you have a reply and we can take it from there. Good luck

I cannot prove that I was asked about retirement or advised about the loan insurance benefits.
    I have received the leaflet about FOS but think perhaps I should reply to Lloys TSB Insurance first with my observations to help clarify the changes in my circumstances from 2001 to 2004.
    Is it worth pursuing.

    This is worth pursuing and you can write to Lloyds again with your observations, there is a possibility that if this was Lloyds final response they may not reply and you may have to move on to the FOS.

  • Hi, I'm hoping this message gets to the right place, I followed all your advice and went back to the FOS. I have recieved a letter stating that although I took the loan out with First Plus, they were it seems a broker for central Trust PLC, who according to the FOS were not members of the GISC when the PPI was taken out on the loan. They say they cannot help me further. Thing is, I took out the loan and the PPI on it through First Plus, I had no dealings with Central Trust PLC. Any Assistance would be Much appreciated!     What they actually mean and are claiming is that Central Trust acted as a broker and introduced you to First Plus. Their argument here is that it was Central Trust who
    "sold " you the PPI, which is all nonensense.

    First Plus will have sold you the ppi and it is they who are responsible for paying you back.
    I am a former Broker, former IFA and former compliance officer, for my sins.

    However, I have since seen the light.

    Are you saying that Firstplus are lying to you and you did not use Central Trust as a broker?
  • I dealt only with First Plus. When I complained sooo long ago directly to First Plus, they said they only brokered the PPI and our complaint should be with Central Trust PLC, i'd never heard of Central Trust.
