Guys if you are going to make threats of court action then make sure you are prepared to go through with it.. Lender know that if you make threats, it is only to try and force their hand.
Refuse, and proceed with court action, it would cost them more that the £487 to hire a lawyer for a couple of hours.0 -

No they have offered me £64 and i have worked it out at £487 and that is without any £12 charges added on, and they are saying that there default sums are both fair and legal, and they are dissappointed i am considering court action. It also says they wont be increasing this amount and its there final offer, and included a settlement form so we can put this behind us and save the courts valuable time xxx
Hi think they playing silly buggars. If you willing to take it further threaten FOS or quicker send a LBA and take them to court. I believe you can do this on line. Have done it myself on a different matter but cannot find the Link. Am sure somebody will be able to help

i have just rang the fos and my complaint has been sent to the caseworker department, all this means is they have written to the company involved asking for all the information from your file and then it goes into the pile for an adjudicator to look at. The guy says they are only dealing with cases from a year ago. I asked what is happening with my case and i was told they wrote to TPF on 19/1/00 and normally give them 21 days to respond. Lets hope the fos asking for my details is enough for them to pay up!!! robbing thieves:rotfl:0 -

Hello, its good you have won through, but help by anyone please as I have followed the advice and sent both PPI template letters as per instructions, but just received letter from Lloyds TSB Insurance rejecting my claim. They have attached 5 pages supposedly being the Personal Financial Interview Record. However as I took this refinanced loan in November 2004 at my next birthday I would have been 64 yet they have down 68, (correct at today's date) which implies this cannot be a copy from 2004. On page 2 its shows "no" to question "Due to receive Full Basic State Pension" which was untrue, I was receiving State Pension from September 2001 paid direct into Lloyds TSB also 2 small private pensions. This interview form also was unsigned.
As this refinance loan was due to attending the local Lloyds bank for Customer Services to run through my accounts to see if they could be of help, their staff member offered me the loan to reduce existing monthly payment. It was seemingly only a formality and the loan application form seems just a copy of the original loan taken out in early 2001. I cannot prove that I was asked about retirement or advised about the loan insurance benefits.
I have received the leaflet about FOS but think perhaps I should reply to Lloys TSB Insurance first with my observations to help clarify the changes in my circumstances from 2001 to 2004.
Is it worth pursuing.0 -
