    hi there i am reclaiming PPI on an old marbles card - the account was settled in Nov 2005 but since PPI was profiled in media i went back and checked statements of old loans and cards. Anyway after sending initial letter i got a reply from HALIFAX??? i telephoed and was put through five different departments before being told to telephone marbles and provided with the number. I made the call and was told the sccount was settled "so long ago that there are no longer any records and they can be of no further help" What do i do now?

    By law The Data Protection Act companies must keep records for up to 6years. They must aslo keep such records for VAT purposes too. Take some photo copies of your statements and send them with letter number 2. Highlight the PPI you are reclaiming. You are aloowed to claim back PPI as far back as 6years. They could be fined for simply not keep your information.
    *write again, include copies of statements. Quote the data protection act.
    * check the FSA register to see when they became regulated by the FSA also to ensure the FOS wh=ill help you deal with your complint should you get no where with them internally

    Always put everything in writing and if you get no answer send it recorded delivery..........Just realised your initial contact with them was by phone not letter DOH!
    So write a letter using the template on the main site include a copy of some statements highlighted. Mention in the letter your phone phone call and make sure to highlight the Data protection Act.

    Im trying to sort my mum out now. Shes been ripped off by Black Horse with PPI. I have wrote to them and they say they wont do anything because they were not Regulated by the FSA at the point of sale. I have double checked the FSA register and it is correct they were not. Is it just straight to the small claims court with this then? Has anyone had any experience of taking PPI claims to small claims court yet?

    hmmm think the best thing to do then is to write again, say i am prepared to take court action if it is not resolved. Give the FO a call just to check they cant look into anything. Then file court proceedings. Reading this if we file for small claims they will be notified we have taken action with a few weeks. that might give them the kick they need to settle out of court. If not i suppose its some more experience for everyone to see what happens. I am sure we aint the only ones with a creditor who miss sold PPI when they were not FSa regulated. I personally had a hiccup with Welcome at first but the FO agreed to resolve anyay... still waiting tho

    (i really must put my spell check on i sound like the policeman from allo allo) haha

    lol I must start using spell check, the mistakes I make then have to go back to change it......:rotfl::rotfl::o:D.

    Yes good idea to write back and tell them, there is nothing stopping you from taking this matter to the courts, it may change the response, hopefully.;)

    thanks so much rosemahairy- i did write to marbles at first (sent recorded delivery) but this letter today from Halifax just threw me so i did get on the phone. Will now definitely check if marbles were on the fsa list and will send a letter as you have advised. Thanks again for your knowledge and advice!!!

    I wrote to tesco at the beginning of november was then passed on to their ppi team in Manchester. Got my reply back in January telling me to fob off. Sent forms off to FOS and received an offer of goodwill and hopefully I should have my money back next week

    I had a credit card with Marbles, this was under HFC. I won a PPI claim with them without the FOS and this was an older account than yours. xx
