    Thanks Amershall, I am standing by my boyfriend cause I love him to bits and we want a future together, he was frightened to tell me about the debt in case i bolted and ran the other way. Lucky for him I didnt ;) so will do what it takes to get the mess sorted out. However it is going to be a long drawn out process by the looks of it since their gameplan at the moment seems to be that they have voice recordings saying my bf accepted the ppi. Utter bol*cks but if i have to take it to the FO like everyone else then thats what i`ll do.

    Hi, can anyone advise? i have made a claim to rbs for ppi on a mint card which i belive was missold. I have their response today after 8 weeks and they are refusing to pay out, the ground being staff are correctly trained etc, however, on their investigations they keep refering to my account being a loan, and my loan application, it was a credit card, is this grounds to take it further in its self? as they state it has been fully investigated when it obviously has not as they keep refering to it as a complaint for loan ppi.

    any advice on what to do next would be great

    hi there welcome, i think this is a fob off, doesnt matter if its a loan or credit card if it has ppi thats what matters, you will get some really sound advice on here, if i were you go to fos enclose replies you have had from rbs, and you may be pleasantly suprised, you may have to wait a while but it will be worth it in the long run. keep us posted

    They obviously have this wrong and I would point this out to them that it is a credit card not loan and add that you are now forwarding your complaint to the FOS. Contact the FOS and fill out a complaint form. I won my PPI back from Mint so its worth a try with the FOS.

    Have RBS stated that this is their final response? If not I would send a further letter stating that your complaint is about PPI for a credit card, point out all of their mistakes one by one, maybe send your letter to the chief executive.

    If you already have a final response, complete the FOS forms, use the guidance on this site to help you & if you need any futher help don't hesitate to shout up, someone will help you as much as you need.

    Evening all!:D

    Just a quick question regarding another ppi reclaim of mine.

    I had a credit card with Morgan Stanley (Goldfish) with ppi attached that was put into my DMP. The debt was sold to 1st Credit DCA:mad: who have been far from nice as they usually are. I've CCA'd 1st Credit and surprise surprise the alledged agreement is completely flawed and unenforcebale.

    They refuse to accept this though and claim to have done nothing wrong, yeah right!:rolleyes: When I questioned the ppi on the account, they rekon it is nothing to do with them and I should contact Goldfish about the reclaim as they bought the debt "in good faith". They insist that the full balance of the debt is still to pay. I sent a SAR request to 1st Credit also asking for all statements regarding ppi, charges etc. They also say that they are not required to send thos info and that it is the responsibility of Goldfish.

    So, are they right? Are Goldfish liable for any ppi reclaim or are 1st Credit liable as they bought the debt and therefore all of the liabilities of it?:confused:

    The ppi reclaim is simple on this as the credit agreement is totally unenforceable and is a multiple agreement, so automatically voids the ppi. The compound interest on any refund would wipe the alleged debt, so i'm keen to sort this one out ASAP.

    Any advice????

    So ive been told that a loan specialist cannot help me as the ppi wasnt over 2.5k,

    Whats my next move?

    If it hadn't been a secured loan i would of challenge the whole shabang and just walked away but thats a different story:rotfl::rotfl:

    If the 8 weeks are up then you can make a complaint to FOS (providing this is within jurisdiction of them) and also add your findings here about the fact they have most probably just sent out a template letter they send to all. On Martins relcaim guide there is a template for filling in the FOS form. Let us know if you want any more help and good luck.
