hi, its rubbish isnt it sometimes, i would like to see all banks and loan companys just give up the ghost now and just accept valid claims (then i woke up lol) then everyones happy!! they should put me in charge, all sorted and paid out within a week!!we just have to keep on fighting onward and upwards xx

Just a quick question regarding another ppi reclaim of mine.
I had a credit card with Morgan Stanley (Goldfish) with ppi attached that was put into my DMP. The debt was sold to 1st Credit DCA:mad: who have been far from nice as they usually are. I've CCA'd 1st Credit and surprise surprise the alledged agreement is completely flawed and unenforcebale.
They refuse to accept this though and claim to have done nothing wrong, yeah right!:rolleyes: When I questioned the ppi on the account, they rekon it is nothing to do with them and I should contact Goldfish about the reclaim as they bought the debt "in good faith". They insist that the full balance of the debt is still to pay. I sent a SAR request to 1st Credit also asking for all statements regarding ppi, charges etc. They also say that they are not required to send thos info and that it is the responsibility of Goldfish.
So, are they right? Are Goldfish liable for any ppi reclaim or are 1st Credit liable as they bought the debt and therefore all of the liabilities of it?
The ppi reclaim is simple on this as the credit agreement is totally unenforceable and is a multiple agreement, so automatically voids the ppi. The compound interest on any refund would wipe the alleged debt, so i'm keen to sort this one out ASAP.
Any advice????

Generally you write to the ones who sold you the finance, however some now write to both of them just to cover themselves, and make them both aware you wrote to two parties, but it seems you have been given the runaround here.
You could contact the FOS to see if they can check who is responsible, hopefully they should confirm who.

Explain to them your problem your having with them.
And in regards to your SAR if your having problems, maybe the ICO (Information commissioner may help) fingers crossed.

Hi Don't give up read my post in successes we had one hell of a battle with Natwest and PPI all letters back from them were discouraging we had to take it to FOS but hung in there and got back all PPi payments plus interest a nice £4,588. It did take a long time. So be determined & Good Luck.0 -
Hi, this is my first time in this thread, but I've been reading all the really helpful advice people have posted on here, as well as Martin's article and am now seriously thinking of putting in some claims.
I've got a current loan with one of the supermarkets, but think I was missold because fortunately my work has a really generous deal if you're off sick or made redundant. I've also paid for terminal illness and redundancy cover privately - separate to the PPI - and have done for years. The Tesco reps didn't go into this and advise me that PPI wasn't necessary in my case.
I also have an existing medical condition which hasn't troubled me for some time, but I'm not sure if this is excluded in the policy or not.
I've put off reclaiming for two reasons - firstly because I was ill last year and off sick from work. Fortunately because work were so good, we've just about been able to make ends meet with a bit of help from our parents and I'm now back part-time, expecting to be full time again by the summer, all being well. I was worried about reclaiming in case I needed to call on the policy, but as I suspected, I've not needed to because of my existing protection from work. I thought about taking out a much cheaper PPI with another company unassociated with my loan as Martin suggests. However, I'm worried I might not get accepted as I've been ill recently, although I am expected to make a full recovery later this year and fortunately it didn't turn out to be anything really serious as the doctors first thought.
I'm also considering making a claim against my bank for an old loan I had before my currrent one with the supermarket. However, again I was a bit worried whether making the claim would either affect my credit rating or affect my day-to-day relationship with the bank. Not that I expect them to be my best friends!!! However, I think Martin warned that you needed a fall-back account with another bank when you try to reclaim your bank charges, in case your bank closes your account as a result! Has this happened to anyone trying to reclaim PPI against their current bank?
Sorry if some of these questions are a bit basic (and if this post is a bit long!!)But I'd really like to cancel my PPI payment (£70 or £80 a month!!!) and see if I can reclaim some money which I could use to pay off part of the debt. The past year has shown that my employer's scheme works and I've not needed to call on the PPI cover at all. I don't know if I could take out a cheaper PPI with someone else as Martin suggests, given my recent illness. Is it easy to take one of these out? I suppose I could try to increase my existing cover with the terminal illness/redundancy/life insurance packages I've got separately?

Hi there Beatlefan. When you took out the loans were you aware that you were also taking out PPI and was it explained to you fully. It does sound as though you have a vry generous package from your Employer that seems to cover you.
I am sorry to hear that you have been unwell recently and hope you soon make a full recovery. I would be very wary of cancelling and taking out a new insurance because I think you will find that you will not be covered for your recent illness. Also if you do not need the PPI why take out a new stand alone protection.
If you willingly took this insurance on in the beginning then you could not have been miss sold.
Saying this I am sure somebody with in depth knowleadge of the insurance industry may be able to advise you about changing your insurance.
May I respectfully say to keep the insurance in place at the moment whilst thinking of your options. If you do decide to keep it then why not make a claim that is what it is there for.:mad:0 -

hi BEATLE FAN, max was really helpfull there. if you have a good package with your employer i too do not see the need for another insurance, i would write to the loans company and say you were mis sold these , your reason is very valid as you are allready protected , when you get the replys back please post on here and you will get very good advice, you clearly have grounds on mis sell from what you say, nothing ventured nothing gained! for the cost of two stamps you could be better off, as for cancelling i would hold on untill you find out if you have a case for mis sell if you havent then i would do what max said and claim on your ins, thats what it is there for, as for your bank falling out with you i am sure di did this with her bank and they have been fine, i have not seen on here where someone has claimed mis sell and the bank has closed an account, i thought it was claiming bank charges that a bank may close your account? i could be wrong and someone on here will no doubt put me right, these are my opinions and if they help you thats good, please dont give up and keep us posted0
