The letter I had back from RBS was there responce to the first template letter.
I dont want to use claim companys or courts. So I am over the next few days going to send the second template letter. Has anyone got any ideas on how to reply to RBSa bout it being to late to make a claim for miss-selling?

    Hi All,

well i've had a response from Mint. they say they can't prove one way or the other whether i was mis-sold the policy but have offered the value of the payments 'as an act of good faith' but no mention of the 8% - should i push for it?

Also they are wanting to pay the money into my credit card account, can i request a cheque?
i've got other higher interest debts i'd rather pay off first and the PPI payments weren't made from my credit account in the first place.

    Thanks,
    Ani

    Hi there

If that was the first response, then write back, you should find the 2nd template for this in the thread where you found the first template.
Hope they resolve this for you, and keep on at them until you exhaust their complaint procedures.;)

In regards of this being late, I think you can still try, it does get more difficult as the years go by, but if you don't try you may never know.

But if the FOS are unable to look at your case later on if you did not receive the outcome you want, I am not sure if you would be eligible to take your case to them, in case the loan company were not under jurisdiction at the time you taken out the finance, such as GISC, before the FSA taken over in Jan 2005, the FOS will only investigate complaints if they were regulated.

Hope this resolves, fingers crossed, but keep trying anyway, good luck.;)

    Hi Ani

Depending on the difference of the amounts, if you can try to get some figures out of them with a breakdown, ask them to send them through the post.

And in regards of EGG, if you've no response at all by the timescales they have of 8 weeks, you are free to take this case to the Financial Ombudsman service, its up to you if you want to send another letter to them, but you do have the opportunity to do this, check this here for more info:
    http://www.financial-ombudsman.org.uk/consumer/complaints.htm

Beware though, the volumes of these complaints are extortinately high, it may take a while before they move your case on to an adjudicator, but you do have a choice, if you want to send another letter, or go to the FOS.

As usual post all letters by recorded post.
    Good luck.;)

Yes write back to them, and if you want to, you can always contact the FOS ready to see if they could help in case you have to move on to them, they will confirm this to you, good luck.;)

I have had a letter from RBS regarding mis selling PPI to me. They have said that the policy started 8/1/96 and ended 5/5/06 and due to the significant passage of time since the policy was sold and the fact I hadd'nt raised any concerns before now the bank believes I am now out of time in which to make a complaint and therefore are unable to complete any investigation into my concerns.
Is this right or are they just trying to stop me making a claim for mis-sale of the PPI?
    Can anyone answer this please?

    This is our course nonesense.
You are still able to claim, especially as the loan was only redeemed in 2006. they are correct that you could not hope to claim on mis-selling alone but there are other issues you can claim on successfully.
I am a former Broker, former IFA and former compliance officer, for my sins.

However, I have since seen the light.

I know that there are a few regulars to this forum who have more than a passing interest in Picture Finacial and the FSCS.

I've been fortunate to have found an excellent contact at the FSCS that has been giving me regular updates as to the status of the case so I thought it only fair to share that information with those that need it most!

Latest update is that there hasn't been any real progress over the last few weeks however his email does clear the mists of procedure that until this point have proved impenetrable:

"At present we are currently waiting on guidance from our Legal Department regarding claims against Picture Financial Services Plc.

Primarily, this is to ensure that the eligibility criteria used to assess Payment Protection Insurance (PPI) claims is consistent for each claimant.

Although I am unable to give an exact timescale for these guidelines to be finalised, please be assured that we are trying to resolve this issue as soon as possible.

Once the guidelines have been agreed, we will then be in a position to determine whether we have received at least one eligible claim against the firm.

Hopefully this won't be too much longer."

It looks as if the finish line may be in sight for those of us that have been part of the Picture Finanace Marathon......Stay strong for the home stretch!
