Been awhile since posted here. But this claim against Lloyds has finally gone to my head and am now considering going in the local branch with a bat and a bag and demanding my money. Lloyds rejected the decision by the FOS so it went for a final decision which was passed in my favour again, this time with added reason that weren't taken into consideration the first time round.
Well it appears that lloyds are ignoring that as well and the FOS has told me to give them 12 weeks, which as a recent redundancy I can't afford to do, this has been explained to the FOS and they accept it and have been in contact with Lloyds and they still won't pay out. They are point blankly refusing too. Have been told by the FOS to seek Legal advice.
Is it possible that I am jinxed or that Lloyds are being difficult just to wind me up further.?0 -

Lloyds are being particularly difficult at the moment. They are ignoring and sticking spanners in the works all the way along. Their latest stint along with other Lenders is to not reply to SAR. What then happens is that there is a backlog at the ICO so keeps everyone waiting again.
Sorry you are having a bad time at the moment makes you wonder if it is the dog wagging the tail or the tail wagging the dog if you see what I mean.
FOS is only like a mediation service so if they are saying to go down the legal route then perhaps that is the best way to go.:mad:0 -

So sorry to hear this news.
I have in-fact posted a post yesterday about these cannot remember if it was on the success or the discussion thread where Lloyds are the main ones who reject at least 95% of these complaints.
You could get legal advice on this hun, but try to search out services who offer them free and do not pay for any upfront, its always best to get advice on these companies.
So basically your case was upheld, lloyds refused and again refused when it was dealt with by the ombudsman himself.
I take it - it did go to the ombudsman which is the final stage then?
Mine also with lloyds through the FOS was upheld was not resolved with the first adjudicator but was passed on because lloyds did not agree to uphold, then when it was passed on to another adjudicator, this adjudicator agreed with the first adjudicator's views and upheld this, it was then resolved, but what the FOS did tell me was, if this was not resolved with the 2nd adjudicator then it would be the financial ombudsman himself.
I had taken it if the ombudsman agreed with the adjudicators to uphold then that decision is settled.
So they are not a willing for this to be looked at by anyone else hun by any chance?The one and only "Dizzy Di"0 -

Barclays Bank Plc
Over a year ago we had a claim in against Barclays Bank over a loan/PPI which they eventually paid out on (£5000+)
Barclays Bank Credit Card
We have just received a letter from the Ombudsman regarding an earlier claim we put in for a Barclays Credit Card my missus had which she had paid PPI on since 1996-2006 (The account was closed and PPI cancelled in 2006).
I quote the Ombudsman:
"You will be very pleased to hear that following our intervention, Barclays Bank Plc has told me that it wishes to offer to settle your complaint on what it describes as a 'goodwill basis' and without any admission of liability."
This is extremely good news to us and reading through the letter from the Ombudsman they are going to pay out on what we wanted, ie:
All PPI paid
8% per year on top of the PPI paid
8% on top of the total PPI & Interest between the day the PPI was stopped and now.
My only concern as it does not state it anywhere is how far back will they pay out. Although the card was taken out in 1996 will they pay back the PPI & Interest since then? I have until 7th April 2009 to accept this settlement, but I'm concerned I could get ripped off. Any advice would be appreciated.
Another part of the letter also concerns me a little. I quote the Ombudsman:
"As yet we may not have considered your complaint. If you decide not to accept the offer and we consider its merits you should be aware that ultimately an ombudsman may award a higher or lower amount or make no award at all depending on the outcome of his investigation."
Just wondering if anyone has had a similar experience and what I should consider doing next.
I'd appreciate any comments/advice.

Could you please tell me if barclays originally refused you under the "time statute barred" argument.
I currently have a claim with FOS about this and it feels like I have been waiting for ever to see if they can sort it out for me.
I took my card out with them in January 2002 and wrote to barclays in May 2002.
I got a letter back from barclays telling me that as it was over 6 years since I took the card out they were not going to pay me anything back as it is considered time barred under the statute of limitations, and it probably falls outside of fos terms of reference.
Its been with ombudsman since June 2008.

Well, well, today has been a strange day. Apparently I'm being fast-tracked for a decision on account of my medical situation. Ironically, in monetary terms, things are going pretty well in that as of a fortnights time, I'll be £380 a month better off (mortgage off fixed rate, council tax arrears cleared - been paying way over the odds for the past 6 months because of arrears from 2004 I was only told about in Sept, and my pay rise coming into play). Because of this, I feel much more relaxed about money, but the medical papers and things have now had an influence with the FOS and I'm now fast-tracked (so, the panic attacks are less of an issue now I can see something of an end in place over my money troubles).Almost debt-free, but certainly even with the Banks!0
