A big congratulations on your success.
Could you please tell me if barclays originally refused you under the "time statute barred" argument.
I currently have a claim with FOS about this and it feels like I have been waiting for ever to see if they can sort it out for me.
I took my card out with them in January 2002 and wrote to barclays in May 2002.
I got a letter back from barclays telling me that as it was over 6 years since I took the card out they were not going to pay me anything back as it is considered time barred under the statute of limitations, and it probably falls outside of fos terms of reference.
Its been with ombudsman since June 2008.

I'm working away at the moment and do not have direct access to all the stuff they have sent me, but I'll be home by the weekend and I'll dig out my stuff and let you know. If I remember rightly they tried fobbing me off once or possibly twice. It wasn't until I got to the Ombudsman that this offer came about. What ever you do, don't give up. A couple of letters, time and stamps could be worth a few bob.

I actually feel quite bad as things aren't as bad as thet were when I made the hardship claim and so many other people are struggling. Having said that, I still feel on edge over money all the time. The PPI stuff being resolved would make such a difference to being able to sleep at night, or just being able to close that chapter in my life.
So, does anyone know what fast-tracked means? Does that just mean 7 months instead of 2 years :rotfl:Almost debt-free, but certainly even with the Banks!0 -

lol, don't feel bad bathgatebuyer, you have already waited long enough and had your own personal reasons for fast tracking.

I thought my lloyds credit card ppi was fast tracked at first when this was submitted in June 08 and was told they were dealing with my case in September, it wasn't until Dec they told me they were then moving it on to fast track due to a change of personal circumstances that then occurred, it was then to be moved on to adjudicator 2 on fast track and not adjudicator 1 on fast track lol.......:D
So all in all mine taken 8 almost 9 months on pay out.;)The one and only "Dizzy Di"0 -

Hi Minx,
Your case will not be time barred by the FOS. Many companies are trying to hide behind time barring for ppi complaints hoping that you will go away. The FOS rules for time barring are that you can complain from either 6 years from when the product was sold, OR (this is a very important OR), 3 years from when you knew, or should have reasonably known, there was a problem. It's the second one that catches them all out. Barclays will find it damn near impossible to prove that you should have known about this problem over 3 years ago, so the claim will still be adjudicated on. The problems in the ppi market have only recently come to the fore in very recent times, so no ppi complaint should be time barred at present.
