Hi All
Letter from Creation yesterday saying that that they have refunded me all premiums paid on Miss Selfridge Card during the year that they administered it and that insurance was offered to me in error.......now to chase GE for the money charged by them as Creation should never have sold it to me in the first place!!!!!

Hi Minx,
Your case will not be time barred by the FOS. Many companies are trying to hide behind time barring for ppi complaints hoping that you will go away. The FOS rules for time barring are that you can complain from either 6 years from when the product was sold, OR (this is a very important OR), 3 years from when you knew, or should have reasonably known, there was a problem. It's the second one that catches them all out. Barclays will find it damn near impossible to prove that you should have known about this problem over 3 years ago, so the claim will still be adjudicated on. The problems in the ppi market have only recently come to the fore in very recent times, so no ppi complaint should be time barred at present.

It just seems to be taking forever to get any answers from fos.
I e-mail them monthly and always get the same answer.
Thought about e-mailing them every 3 weeks but dont want to tick them off and get delayed in anyway.
I know they are extremely busy but there doesn't seem to be any system in place.
Some people have been waiting almost a year (myself included) while other people seem to only wait a couple of months. Even people who are eligible to be fast tracked seem to wait a really long time.

Hi All,
Just thought I`d update you all on my reclaims with Halifax and Capital One, originally wrote to them on 09March reclaiming PPI which was missold to my BF and they have both come back with virtually identical letters.
They both say that they have recorded telephone conversations where they clearly advised him about PPI and that he agreed to take it. I know that is utter boll*cks! I dont beleive for a minute these financial establishments tape record and hold records of EVERY conversation they have, they just dont have the technology to hold and store ALL that data. Do they think we are total idiots just because they treat us as so :mad:
Anyway, im sure this is just a fob off tactic so I am going to contest this and ask for a copy of the recording they supposidly have.
Anybody else had to do this with them and if so were you then successful in getting your PPI back once you had pursued the matter.

Hi Do not be put off it is the usual tactics. They are just relying on the fact that most people give up at this point. Send of the full SAR which asks for all the relevant information etc.

Thanks Max, presumably the SAR request means as well as supplying written documentation they have to provide any verbal recording as well??
If they then cannot supply the recording would it be better to go straight to Ombudsman rather that keep writing letters requesting it, just dont want to waste time if they are not going to play ball as I know when it goes to FO it could take up to a year to be successful due large volumes of complaints they must have

You keep at them, they are trying to use stalling tactics and if they do have recordings then should supply them to you on request, I agree contest this, go all the way, good luck and like Maxdp says if you need any help just give us a yell.

Thanks Di, I didn`t think this would be an easy task but its been draining these last 6wks trying to sort all this out! I know they are stalling and probably lots of people give up and go away at this stage but im prepared to stick with it for my BF sake as he is going to have to do DMP in order to try and have a life and anything we may get back in ppi would help enormously in clearing some of this mammoth debt.
