If your bank has advised you of the the amount they are repaying you, yet they are failing to send you a cheque, use this template letter advising them that you will issue a County Court summons against them.

    http://www.scribd.com/doc/73729644/Document

NOTES BEFORE YOU SEND THIS LETTER
1: If you currently owe your lender monies be it a credit card or loan
they have the right to offset your claim against monies owed
    DO NOT SEND THIS LETTER
2: If you DO NOT owe the lender monies and believe that payment of your claim will be direct to you, then please use the letter.

To issue County Court summons is simply, a request will cost about £30 which will be added to your claim meaning the banks will be pay

YOU CAN START YOUR CLAIM PROCESS SIMPLY ONLINE
    https://www.moneyclaim.gov.uk/web/mcol/welcome

As the banks have already confirmed the amount to you, they will not go to court which means you will win by default. The court will then order the bank to pay the full amount plus costs.

Should the bank ignore the instructions of the court, you can then instruct court bailiffs to visit the banks address to recover money.

With the reclaiming of bank charges, there was a case with Natwest by a Reading man. The bank did not turn up at court so he won by default. Natwest ignored all this so he requested the bailiffs called.
    This was Natwest, Tilehurst Reading.
The bailiffs called and after a fair bit of disruption, Natwest paid the bailiffs.

The manager of Natwest Tilehurst now ensures that before he goes to work in future, he dons a pair of nappies, just in case ???

thanks for that, I have £12 until I get my cheques so this will be very useful if they don't cough up what they owe me:A
    MBNA Upheld £20,663.63 2/11/11, cheque recieved 25/11/11 :j
    Capital One Upheld 11/11/11 £2793.21 cheque recieved 2/12/11 :j
Santander rejected by them 11/11/11, counter rejected by me 17/11/11. x2 letters advising they need another 4 weeks and then another rejection:rotfl:
  • I submitted a claim to Nationwide for MPPI. I received an acknowledgement on Saturday advising they are investigating and will get back to me within 8 weeks but they also asked for my & hubbies signatures to be verified so I had to fill a form in at a local branch to confirm this which we did yesterday.

I also received another letter from them yesterday chasing up the verification of the signatures (4 days after the first acknowledgment) as they said they couldn't provide a Final Response until this was received.

I called them this morning to advise we did the signature verification yesterday and since they were chasing me up for this, were they in a position to confirm if my claim was being upheld or not. The girl advised no & that it would be nearer the 8 week timescale before I got a reply!

Why then did they chase me for this??? I first thought it was stalling tactics but when I got the chaser from them yesterday I thought they must be upholding my claim and needed this before they could confirm??

All very frustrating!!! Has anyone else had to do this for Nationwide or any other banks & does it look hopeful that they will be upholding my claim??
  • Can nayone please provide me on any guidance on the actuall proces of PPI investigations.

I have complained to the tescos', who have referred me to FOS. Fos have comfirmed that they have contacted Tesco's and that they have admitted that i was miss-sold.

FOS state i should be reciveing something from tesco's....tescos's say they will not deal direct with me, but with FOS, who in turn will contact me.

Why is somthing so simple so confusing.
    Current debt:
    Barclay Card - £4900, Creation Card - £7000, American Express - £2400, Nation Wide Card - £3600, Black Hourse Loan - £10500, Car Finance - £5k.

  • Help needed, I have been to my bank today regarding a loan I have with them and the ppi, I wanted to see if I could cancel the PPI to reduce the payments, the lady I spoke to stated that I would have to cancel the loan and then reapply which may make the payments increase??? I have found the documents I was given in the beginning and cannot see anything re cancellation!!

It's quite simple really, considering they have already confirmed to FOS that i am due compensation.

I have already spoken to FOS regarding this "letter" that they sent to FOS on the 24th October. They are recalling my File and should get back to me within 48 hours with the content of the letter.

In the mean time, i got an actuary friend of mine to see if he could potential figure out what kind of compensation i could be looking at. His figures came to around the £12k mark which would be quite handy if its correct.

  • Hi all,
How do I find out the accout number of a card which I closed in 2008?
I didn;t even know I was paying for protection until I got into trouble as the bill kept going up over the limit each month, even though I was paying the minimum ammount.
    Thanks in advance.
