    Beware of MBNA, they are saying "cheque in the post", when it does not arrive, "oh must have been lost" ???? These delaying tactics are futile ... is MBNA running out of money, I think so

    I helped a work colleague fill in the form and send it off to MBNA for both herself and her husband accounts 3 weeks ago, she had a upheld letter for her account on Tuesday this week and the cheque arrived two days later, but has heard nothing for her husband!
  • Hi, few weeks back I posted about barclaycard rejection and the lovely Di helped me draft a letter. So I wrote the following letter:

    relation to your final response dated 22nd October 2011.! I am not happy with the outcome of my complaint and strongly believe I was missold this policy.
    !
    It’s ironic I did a subject access request on the 29th July 2011 and no information with regards to this card was sent to me.! When I was informed about the rejection I ask for a copy of the application to be sent to me, however the advisor stated she can she where it was ordered but she cannot see it on the system. However, if you no longer hold these details, please could you explain why you rejected my complaint?
    If you do can I have a copy to be sent out to me please?

    I also note you have ignored my statement on the FOS questionnaire “that when I called in 2004 to cancel the policy I was then recommended Barclaycard credit protector by YOUR advisor stating it was to protect my purchases, only to have found out recently that this is another form of PPI policy”.

    I strongly believe both these policies were worthless to me and as a valued customer - I am requesting you review my complaint. I gave you my reasons (especially to the fact I was on a temporary contact and had not been working 12 months prior when the card was taken out which was one of your MAIN exclusions which wasn’t clearly highlighted and I believe you have overlooked or not investigated my complaint properly.

    Even if the policy was signed /ticked for this doesn’t constitute an immediate rejection, as it obviously was not discussed with me at the time this was sold, because otherwise I would have known I would not be eligible to make a claim. What would be the point in me having Payment Protection Insurance (PPI) if it was not suitable for me?

    As a bank, your staff had the responsibility to make sure when they sell these products to do so with interest of the customer.! I now believe the bank have failed me, and were not interested whether I would be eligible for the policy or not.
    !
    The guidelines for you to follow in 2002 were also set out in the General Insurance Standards Council (GISC) code and that the members would:
    1.!!! Act fairly and reasonably when we (Barclaycard) deal with you (customer)
    2.!!! Give you enough information and help so you can make an informed decision before you make a final commitment to buy your insurance policy.
    !
    The GISC code provisions further include that:
    !
    1.!!! 3.2 We will make sure, as far as possible that the products and services match your requirements.
    2.!!! If it is practical we will identify your needs be getting relevant information from you.
    3.!!! 3.3 We will explain all the main features of the products and services that we offer including, any significant or unusual restrictions or !exclusions (NOT BE IN TEMPORARY EMPLOYMENT), any significant conditions and obligations which you must meet (NEED TO BE WORKING WITH THE SAME EMPLOYER FOR AT THIS 12 MONTHS PRIOR TO APPLICATION) all of which I didn’t satisfy.


    The FSA have also addressed this in their open letter as well: Whereby the firm sold a customer a policy comprising one or more parts under which he was not eligible to claim, first:
    !
    1.!!! Take reasonable steps to ensure the customer only bought a policy under which he was eligible to claim benefits or
    2.!!! Disclosed to the customer in good time before the sale was concluded and in a way that was fair, clear and not misleading.
    !

    So yesterday they wrote Saying they've reviewed my complaint and my application was in branch n they can't determine whether I agreed to PPI so complaint upheld ( ok they initially rejected saying I did a postal application and I also ticked the box). So now I should be happy, no no barclaycard still wants to play games by offering me a refund of 390.00 pounds. Apparently my I paid only 211.00 ppi as it ran from 2002 to 2005 then changed to some credit protector.

    However by my calculations they owe around 1500 due to compound interest on my payments and my APR was 24.9%. can someone correct me if I'm wrong. Plus my premiums n statutory interest. So now I have to write back!

  • I took out a graduate loan in 2008 with barclays and questioned whether they had mis sold me my ppi, turns out they did - I followed the easy to follow directions on this website and sent off all the paperwork. 6 weeks later I have recieved a letter from barclays giving me back £1752! Didn't expect them to make me an offer! Very impressed. Waiting to see if they are going to give me my ppi of £400 on a previous loan - which I think they will if they have paid out on the first claim I made and am now off to tackle capital one!
    Very impressed with advice and support given on this website!
    Best thing I ever did!!!!

    Hi everyone, I am currently claiming back PPI on a Barclaycard debt which I am paying through the CCCS but which has been sold on to a DCA. If successfull am I right in thinking that the payment should be sent direct to me as opposed to reducing the debt as Barclaycard have already sold the debt on ? Your help is appreciated.

    I'm about to write a SAR to Natwest I too had a graduate loan taken out in 1995, I reckon there willbe PPI on it which I did not need. Fingers crossed ! And good luck with CO, I found them quite straight forward but they've been difficult with others, don't forget to shout if you get stuck!

    Santander rejected by them 11/11/11, counter rejected by me 17/11/11. x2 letters advising they need another 4 weeks and then another rejection:rotfl:

    I need some advice.(for a change)
    I got in touch with RBS ceo who forwarded my email to a member of the ppi executive concerns department. I was asking about the restructuring of a defaulted loan which has been getting paid off over the last few years. This loan was the last in five that had been consolidated each time and the ppi complaint was found in favour of it. I believed that this loan should've had the ppi plus it's interest removed and along with the payments i've made through the debt collection agency would've gave me my new outstanding balance which I was going to pay off. They say no it's complicated etc etc made worse by the consolidations made and the arrears.
    Loan was 9000.00
    ppi was 2238.00
    ppi int 1976.60
    loan int 3873.40
    total 17088.00

    Over the years I've paid off about £7500 leaving outstanding just under £10000, so they are giving me a refund on this loan of about 7655.53, this obviously includes something from each of the loans that was consolidated, but they are not reducing the loan amount, they have taken just over 6300.00 from my total ppi redress and subtracting from the outstanding debt and leaving me with a new balance of just over £4400 and giving to me the interest etc of the total redress amounts.

    I've asked the person concerned why i'm not receiving the ppi and it's interest being removed from the loan amount, then subtracting the repayments i've made so far, THEN paying it off with any of the redress but she says no it's complicated, is it time to speak to FOS/FSA in regards to this?

    I'm not in dispute with the redress at all, it's more than I thought i'd get overall, but not happy about the 'restructure' which doesn't seem to be happening.

    Hope you can help, it's my birthday too today and would like if possible to get some help from you wonderful people on here so that I can take forward some suggestions on Monday.

    Thanks again and have a great weekend, i've also been told the cheques are in the post as well, so hoping the postie comes soon.

    Hi african queen welcome to the forum, the other guys know more about credit cards than me but i think i'm right in saying that they only pay the 8% simple interest not compound and interest is only paid when the account is actually in credit, hope i'm not misadvising you but that is my understanding of the way they work

    Hi minty i would wait and see what happens if the redress gets sent to the dca you can always challenge it.
