    Hi,

Not sure if this has been covered before but my partner had a santander credit card which has since been passed to a debt collection company whick we are now paying £50 per month. Do we make the ppi claim to Santander or the debt company.

Again sorry if this has been dealt before.

"Our systems show that there is no sum payable under the credit agreement"
This means the product is paid off and you owe them nothing, this will relate to the 2 loans that are settled.
Send the SAR requests for each and give them 40 days to get this info to you.

    Hi Everyone,

Looking for a bit of advice. I have undertaken a PPI claim on behalf of my mum for a Monsoon store card she took out.

She has received a letter back from Santander which states: 'This matter has been investigated in full and we issued our final response to investor compensation'.

Please could anyone help me with what this means and how I should proceed.

    Kind Regards
Hi,as Dilus said this is a claims co,you need to contact them and ask them if your mum employed their services and how far have they got with your complaint.

With this being a "final response" as the claims co have not been in a hurry to let your mum know, they may have rejected the claim,as if it was upheld, you can bet your bottom dollar that you would have recieved something from them sooner rather than later.

    DATA PROTECTION ACT 1998
    SUBJECT ACCESS REQUEST

    Date: xx:xx:xxxx

    Dear Sir/Madam
    Name xxxxxxxxxxxx
    Account No’sXXXXXXXXXXXXXXXXXX

    Hi "dizzy di"

Is this the letter to be used to ask for a full breakdown of your whole account? Im starting a claim for the other half, it ended 2 years ago and he has NO paperwork other than the reference number. is it worth asking for the full account (£10 letter) or the credit agreement letter (£1)?

    thanks in advance

    Hiya

So sorry to have missed you, and yes as amersall says, its the correct one.;)
Cheers amersall and sorry I have not been here much.:);)

I would also post it by recorded delivery as well, and if your other half had a few accounts taken out with the same business, one SAR will cover all as will the one payment of £10 cheque or postal order.

If you just wanted a copy of the agreement, that is the one for a £1 which they should provide by 12 days, and that is just a simple letter asking them to send you a copy of the agreement, and give the account number and or any other details, name, and all addresses, date of birth and so on if you do not have the account number, same goes for the SAR - so they can try tracking down the data.

However, if the account is no longer active, they may come back and say they are no obligated to send this document, but they MUST comply by the SAR letter as its within the law of the Data Protection Act (DPA) or they must return your payment enclosed with a letter to explain.

    Hope this helps, good luck.:)

Good morning Cappo I have over the past six months been posting various comments about getting my ppi back from the RBS and how long it has taken, anyway I rang up the helpline as I normally do each week and a very nice man told me the calculations have been done but not sent up yet so you can expect to wait at least two weeks for the cheque, anyway I felt it had moved on so I had two weeks of no stress knowing the cheque wasnt going to arrive - guess what Cappo my hubby is busy painting the bathroom, and the postman drops the post through the door - I didnt even bother getting up the hubby picked it up on the way to get more paint and I cant believe this my cheque has arrived from the RBS for over £7000 it has said tax from the interest payment has already been deduced as I am still working and a tax payer I have no objection to that.
Cappo Di Beamerguy and all you :jsmashing people out there one thing you showed me was not to give in keep at them which is exactly what I have done e-mails phone calls etc as my case had been in since last September I felt I had waited long enough,
A million thanks to you all on this forum - I hope you all get your ppi back with - I am off to pay the cheque in the bank my bank opens on a Saturday and get that bottle of champagne I have been waiting for so long.
I am still going to be part of the forum I am going to start on my other small claims -thank you all again we owe you all so much :j

Sorry for my delay in responding!

  • Many thanks for your response Dilus and Amusall!

Well interestingly enough she has not contacted any claims companies regarding this. Using the PPI template we filed the complaint directly with Santander.

Looks like I will have to contact Santander and discuss further with them

Hi, this one is interesting. If the debt collector is acting on behalf of the bank, then claim from the bank.

If the debt collector purchased the debt from the bank, then they have taken over intellectual rights and you would persue the debt collectors

Debt collectors, being greedy people, have fallen foul by buying contracts not knowing the liabilty attached to them, that liability is the PPI.
So you need to contact the collector and ask if he is acting on behalf of the bank or if he purchased the debt, they are obliged to tell you
  • Hi, I posted a few days ago but not heard back.
I am claiming for mis sold ppi's through HSBC. I called them and they said I had 4 loans with PPI's against them. I have written a letter to request it back. I no longer have any loans with them or the paperwork so I am hoping they still will. I do remember years ago when I took out the loan I was told once that if I died my loan would have to be paid by my parents if I didn't have PPI. That is wrong isn it? for an unsecured personal loan. Hopefully I will get something back, but I just don't know how much.. eek
