    Hi jodilye,
You say you entered a contract with the claims company, then I'm afraid that they can expect their cut which is normally around 25/30%. I'm surprised that they don't know if you have been successful, they are normally informed by the bank in question and will chase you for it. You need to check T&Cs from claim company to see how much you owe them and after you receive payment from the bank settle with the claims company. I hope you were not in arrears on the loan/cc because if you were the last thing you should do is employ a claims company as you could end up out of pocket despite the repayment. Wait until you get the payment and then you will have to inform them and settle up :(

    Hi, thanks for your reply.
When I say I entered a contract; they sent me some forms which I signed and sent back. The only correspondence they have sent me since has been one letter and many texts asking if I had received anything from the bank. Now that I have I haven't heard anything from them. For some odd reason I don't have anything else that they have sent me. When I called the company it was quite spur of the moment and I just thought it was a simple call, followed by them doing the work, taking half the money, that was that. So no, my loan has not been fully paid off. My mum told me to look at it as only getting half, accept the payment and then call the company and possibly pay them half, same as what you have said.
Lloyds have said in their letter that if I don't reply they will pay the money straight into my bank anyway. They don't specify what time period this would be in.

Thanks for the advice, it appeals to my more sensible side of my brain...I'd like it if the company simply got in contact first, I feel silly to call them to voluntarily offer up half of my money!

So many questions so few answers! Thank you for your reply. It seems, in a move entirely unlike me, I have got rid of every single piece of correspondence the company have sent me. I would have only done this if every bit looked like junk though...
    Anyway.
    1. I am happy with the offer, I never really expected to see the money again so anything's a bonus.
    2. I never contacted the bank directly.
    3. The only time the company have been in contact is to ask if my bank has contacted me directly. Each time that I received a letter or text regarding this it was N/A as I hadn't received anything.

I have just found one email from the company from when I first contacted them, they are 'investor compensation'.

The 50% fee was never sent in writing as far as I remember, only mentioned over the phone. Lloyds say that if I don't get in contact with them they will consider the matter closed and simply pay me the money. If they do that and the company still don't get in contact with me, is that wrong..?! (morally I mean...)

If the company dont contact you get LLoyds to pay you and if that company contacts you again, just say you got it on your own, sounds like they may not be trading as these companies are normally hot when they are owed money, but as you say the 50% was heresay then they don't have much of a leg to stand on.

There are NO MORALS in banking as you have already seen, so forget that one

Haha, yes my family are all looking over old CC's and loans for PPI. Actually my aunty just got £4000 back but paid a company to do it, even though she filled the forms out herself. I didn't fancy paying someone to do something I could try doing myself... It does get a bit obsessive. I work in a shop and keep asking the regulars if they have had PPI , lol. Fingers crossed I'm lucky with clydesdale then. The PPI is still running on the visa will that affect my claim at all? How long can these cases take, worst case scenario?
Thats good that you spread the word, one of the guys in my work actually said to me on the quiet that his girlfreind might've had ppi on a mortgage and some loans, so I wrote everything down on an email with links to the ppi reclaiming guide on here and the complaints form from FOS and said if they need help let me know and i'll assist.
The more that complain the more that become more aware of the unscrupulous, fraudlent acts that our banks will do to make money from us 'lay'people, and I think their attitude just makes us believe that they think of us as second class citizens.
How long can they take..well how long is a piece of string. The FSA have said that for complaints received between 31st August and 31st December they have 12 weeks to give you a final decision on your complaint, after 31st December it goes back to the original 8 weeks for that decision, unfortunately there is no time limit on how long it takes to pay out on an uphold decision. If the give you a decline on your complaint you can then go to FOS if you wish but complaints there can take a good year to 18 months to complete. If they are just delayed and not given a decision sometimes it is better just to let them get on with it, although it is good to keep up the pressure on them by phoning the ppi team(if you can get through) or emailing the CEO - I have email addresses for Clydesdale Banks.

As for still having the ppi on your VISA you can cancel this at any time, it wont affect your complaint at all. As when they recaluclate your card account they just work out what youre balance would've been if the ppi hadn't been on your account, and the difference's this would've made with the interest charged to your account,
unlike loans ppi you don't get the standard 8% interest, unless, your account when restructured goes into credit, which you get the 8% on that.

Hope this helps:DAnything else just holler:D
Thanks to all the competition posters.

Just wanted to share my update...
I had my first decision letter from Barclays today when I got home from work (I have a number of claims in with them). It was a rejection unfortunately, with the reason being like many that I have read of on here i.e. no evidence of PPI payments could be found due to the amount of time passed...blah, blah...final response...no recourse to FOS as this loan was taken out prior to them signing up to GISC.

Then there was a line saying if you can provide evidence of the payments such as the PPI reference number or paperwork, then the will reopen the complaint. This was puzzling as I had complained using the standard questionnaire, including the PPI reference number and attaching a copy of the original policy documents. It clearly sets out the amount of PPI that I paid.

So it would seem that it took them two months to completely ignore the information I gave them and to simply give a stock answer  This is appalling customer service.

I called customer relations straight away and spoke to a decent bloke (to be fair) who was apologetic and rather embarrassed. He couldn't understand how that decision could have been made. He re-opened the complaint straight away and updated the file including the PPI reference number and read back to me what he had written. He said there was no need to resend the evidence at this point.

So it's back to square one - I'm keeping my fingers even more firmly crossed now

    Cheers
    KG

Hi KG i do pity the few honourable people the banks have left on there staff as the majority of them just try to lead us all down the garden path.

Seriously though.............if like me, you've had numerous cards/loans etc over the years, but didn't retain any paperwork once cleared or transferred, where do you start?
Look back at your dd list if you had internet banking, this will show the account number, try your credit report you may find info on there.
If, like me, you have been chopping and changing credit-cards/mortgages etc every 2 years or so, and have little or no paper record of what card/mortgage you had over which time period, how on earth do you start to even thinking about claiming PPI back?
You need to find the loan numbers for any finance you have had.

Credit cards.all you need is the card number to ask for info they hold on you.

Not sure how far forward you would get with this,as you dont know the banks you were with.
Look at your credit file as i suggested (this only goes back 6 years though,so you may hit a stumbling block here if you had anything prior to this and it was cleared) direct debit route may help.

Try these methods, someone else who maybe knows another route you can take may post and help with this.
The alternative is,to phone every bank and cc company, give them as much details as you can and ask if they can find you on their records!!,this is a long shot, but you never know.
  • Just got another rejection letter from santander
I thought I had taken this card out in 1990 when I was self employed, but according to their records I took it out in 1986, when I was 18 and in a temporary job. They say they cant locate my original paperwork but they knew when I took the card out.
I took out an account card in 1986 and paid it off in 2003. When I got my SAR information it stated
July 1999 Customer phoned and said that she never asked, needed or wanted PPI so I have cancelled the policy and refunded the customer the last months PPI charge of £11.10

I have sent a letter back asking that they take this further information into account and the FOS handbook guidelines. Santander said that I could go to FLA if unhappy but they are a bunch of chocolate teapots-useless, should it go to FLA or FOS if I'm turned down again, which I expect from Santander
    Thanks Lisa
