PPI Reclaiming Discussion part 4

Just wanted to share my update...
I had my first decision letter from Barclays today when I got home from work (I have a number of claims in with them). It was a rejection unfortunately, with the reason being like many that I have read of on here i.e. no evidence of PPI payments could be found due to the amount of time passed...blah, blah...final response...no recourse to FOS as this loan was taken out prior to them signing up to GISC.
Then there was a line saying if you can provide evidence of the payments such as the PPI reference number or paperwork, then the will reopen the complaint. This was puzzling as I had complained using the standard questionnaire, including the PPI reference number and attaching a copy of the original policy documents. It clearly sets out the amount of PPI that I paid.
So it would seem that it took them two months to completely ignore the information I gave them and to simply give a stock answer :mad: This is appalling customer service.
I called customer relations straight away and spoke to a decent bloke (to be fair) who was apologetic and rather embarrassed. He couldn't understand how that decision could have been made. He re-opened the complaint straight away and updated the file including the PPI reference number and read back to me what he had written. He said there was no need to resend the evidence at this point.
So it's back to square one - I'm keeping my fingers even more firmly crossed now

A few months back I called one of those ppi reclaim firms just to see if they could do anything for me, didn't really think I had a case and didn't really know how easy it was to claim myself. Left it with them on the grounds I had been mis sold as I already had sick pay with my employers that would have covered me apparently. Got a few texts saying if I had received anything from the bank concerning settlement to get in contact. At the time I hadn't had anything,so I ignored the texts. This morning though I got a letter from the bank offering me just under £250. I was expecting the ppi company to end up getting me about £50 after they'd taken their 50%(!) chunk. Obviously I am delighted I could get this back from the bank but now don't know how it works as I've already entered into a contract with the ppi company. If I call them to say I've had a letter I have a feeling I won't be able to take the settlement offer and then they will still take their percentage. I know they did the legwork for me but still not sure who calls the shots.
Any help greatly appreciated,

You say you entered a contract with the claims company, then I'm afraid that they can expect their cut which is normally around 25/30%. I'm surprised that they don't know if you have been successful, they are normally informed by the bank in question and will chase you for it. You need to check T&Cs from claim company to see how much you owe them and after you receive payment from the bank settle with the claims company. I hope you were not in arrears on the loan/cc because if you were the last thing you should do is employ a claims company as you could end up out of pocket despite the repayment. Wait until you get the payment and then you will have to inform them and settle upSuccesses

Look back a page or 2 and a member called Beamerguy has posted Bob Diamond's Email address on this thread, tell him how unhappy you are and it may well speed things up for you.

BUT oddly enough a few days after emailing the cheif exec of barclays kicking off about how pi##ed off i was with them and demanding it get sorted ASAP, a woman was on the phone telling me how much they were giving me.....and the cash was paid into my bank account same day!!!
Look back a page or 2 and a member called Beamerguy has posted Bob Diamond's Email address on this thread, tell him how unhappy you are and it may well speed things up for you.

It is odd that whilst the claims company contacted the bank, it is odd that the bank contacts you direct. Firstly, are you happy with the offer, do you think it is correct ?
50% by the claims company is very high, who are they ?
Did you ever contact the bank about this yourself ?
Have the claims company been in contact with you ?
Are the claims company still operating as many have had their licence taken away by the FSA ?0 -
Firstly, I think the lack of Clydesdale/Yorkshire Bank details are because not many of their customers come on here, plus when the figures were released for how much they were putting aside for claims, it was only a couple of million compared to £3.2bn for the Lloyds Group. So in comparison they obviously have a much smaller list of customers who could claim.
If you're completing a SAR to them they have 40 days to comply, when I done this with RBS, information came in from different sources, one from credit card centre, one from loans and another from accounts, with copies of statements that I had requested. If they fail to comply with the 40 days you can complain to the Information Commissioners Office.
Also if you know you had ppi and have your account numbers and reasons for mis-sale you can do file your complaint and wait for the finer details, all you need for your complaint is as said, account numbers, rough dates and your reason's.
Don't worry too much about becoming obssessed, most of us on here have done the same, my work colleagues, wife, family are all sick to death of listening to me harping on about ppi, but to be honest I don't really care, my wife has had several of the wins on my signature to do with as she pleases(well almost) the bank of scotland cc win and tmpp win are sitting burning a hole in her bank account as we speak, earlier she practically redesigned the whole downstairs of the house, with new flooring, corner suite, decorating the walls new units etc etc.
It's good to keep up with each days updates but you can go for days with nothing much going on, especially at the weekends, i've seen sometimes two or three of us holding the conversation.
I've also been quite boring but it helped and I read the FSA guidance on the ppi saga, and several times over months, and I used to post sections that would help people when putting in their complaint or even appealing a rejected complaint as the lender didn't seem to pay much respect to the guidance.
My advice keep your finger on the pulse to know whats going on but make time for other things too, and if anyone complains, just say that you'll remember that when you get your money and they won't be included in the celebrations!!:D
Haha, yes my family are all looking over old CC's and loans for PPI. Actually my aunty just got £4000 back but paid a company to do it, even though she filled the forms out herself. I didn't fancy paying someone to do something I could try doing myself... It does get a bit obsessive. I work in a shop and keep asking the regulars if they have had PPI , lol. Fingers crossed I'm lucky with clydesdale then. The PPI is still running on the visa will that affect my claim at all? How long can these cases take, worst case scenario?0 -
Hi all, I had a quick read through this thread but it's pretty hefty so apologies if this has already been answered!
I decided to claim my ppi back through the company iSmart. Back in early February they started to deal with it and request info from my bank RBS, but then they said that due to the ppi court case RBS were refusing to handle ppi claims. In August I finally got word from iSmart that RBS were ready to start dealing with my case, but RBS were refusing to cooperate and iSmart were going to refer my claim to the FOS. In early September I recieved another letter from iSmart requesting that I send them a second original letter of authority to give to RBS, so that was sent. Later that same month I finally recieved a letter from RBS themselves saying that they were looking into my claim and cancelling my ppi as I was obviously unhappy with it; they also sent a page detailing their complaints procedure. The next day an email arrived from iSmart telling me that they had referred my claim to the FOS, and when I told them about the letter I had recieved from RBS they knew nothing about it. It's now past the 8 weeks mark of the complaints procedure and I haven't heard anything back from RBS yet, and I gather the FOS can take some time to come to a decision.
Anyway, the long and short of it is that it was a mistake to use iSmart. They started dealing with my claim in February and it is now November and still no results of any kind, not even a rejection.
Can I tell iSmart that I don't want them to handle my claim anymore? I really can't see the point in paying them 25% of anything I get (if ever!)0 -
