PPI Reclaiming Discussion part 4

Hello,
First post on here so not 100% sure how it all works. Anyway, I'm contemplating making a claim to MBNA and Barclaycard for PPI I think I was mis-sold, I've got two questions though, firstly I once used the insurance on the MBNA card, will this invalidate the claim? And secondly, I still have balances on both cards, if I were to be successful would the lenders demand payment in full of both outstanding balances as this is something I would not be able to afford to do.
Any help would be much appreciated.
Thanks

I think they can pay off any arrears, but not the balance ITMS.
What was your reason for the mis-sell? It's always useful to have one of these;)
Once you have all your facts straight it's really easy;)MBNA Upheld £20,663.63 2/11/11, cheque recieved 25/11/11 :j
Capital One Upheld 11/11/11 £2793.21 cheque recieved 2/12/11 :j
Santander rejected by them 11/11/11, counter rejected by me 17/11/11. x2 letters advising they need another 4 weeks and then another rejection:rotfl:0 -

Pardon my ignorance but what does ITMS stand for??
I don't actually know my reason as it was a few years ago when I first took out these cards, I just know it's not something I would've asked for, do I need a nailed on reason, again apologies for my naivety!!0 -

Hi Patrick, regarding MBNA, you may well have a problem as you have claimed on the insurance, its would be like filling your car with petrol and denying it later. Regardless, it depends what else the policy says and if it would all be applicable to you in its entirety, if not, you may have a basis for a claim
RE BARCLAYS, go ahead and claim.
They cannot make you make pay the balance if you win PPI so dont worry about that0 -
Hi,
A few months back I called one of those ppi reclaim firms just to see if they could do anything for me, didn't really think I had a case and didn't really know how easy it was to claim myself. Left it with them on the grounds I had been mis sold as I already had sick pay with my employers that would have covered me apparently. Got a few texts saying if I had received anything from the bank concerning settlement to get in contact. At the time I hadn't had anything,so I ignored the texts. This morning though I got a letter from the bank offering me just under £250. I was expecting the ppi company to end up getting me about £50 after they'd taken their 50%(!) chunk. Obviously I am delighted I could get this back from the bank but now don't know how it works as I've already entered into a contract with the ppi company. If I call them to say I've had a letter I have a feeling I won't be able to take the settlement offer and then they will still take their percentage. I know they did the legwork for me but still not sure who calls the shots.
Any help greatly appreciated,
Thanks0 -

Hi, just wondered if anyone could give me some advice. I have obvoiusly seen all the media coverage on PPI claims, but was led to believe this was in relation to loans and credit cards only. Upon reading some info here on MSE I believe my Mortgage PPI could fall under this category. I currently pay over 50quid a month since 2005 for Disabilty and Sickness cover yet have very good benefits with my employer and a secure job (circumstances same since policy started). At the time of taking it out i was 5 months pregnant with my first child, buying my first house in a hurry (to be settled before the birth etc, have room for a baby), inexperienced in these areas, convinced it was "essential, especially as you're about to become parents" etc. Do I have a claim??
Also, it was sold via a Financial Advisor, do I claim the insurance provider or the Financial Advisors?
Just had my 2nd child and finances are stretched, so I've been re-evaluating all of my outgoings, shopping around for insurances etc and this is part of my attempt to save/reclaim money. Any advice would be great
Thanks

Hi Amanda,
point is, HOW were you sold the PPI, were you told you had to have it to get the mortgage, was it fully explained to you.
Financial Advisors ARE strictly controlled by the FSA so if he/she mis-sold this you, they could lose their licence.

Just to say our successful claim with Bank of Scotland had interest calculations up to 2nd November 2011.
I called them this morning to say we had not received the cheque - the very nice man (god I feel sorry for the staff), said that the cheque had not been raised yet.
I asked if there was anything he could do and he put me on hold to speak to the payments team.
He came back to say that they were aware of the overdue nature of payments calculated to this date and that it was being treated as priority.
I don't hold out much hope of seeing it anytime soon but thought it might be useful to anyone else waiting.0
